This, the 14th day of October, 1940, came on to be considered by the County Judge oP Ker
County, Texss, the petition oP 50 freeholders of Commissioners' Prec inot #4, a aubd iviaion of
said County, for an order of election in such subdivision for the purpose of enabling the ire
holders thereof to determine whether Horses, N,ules, Jacks, Jennets and Cattle ehall be permit
ed to run at large therein, and 1t appearing to the Tudge of said Court that suoh petition
was filed with the Commissioners' Court of Kerr County on the. 12th day of October, 1940, end
that such Court thereafter, on the 14th day of October, 1940, heard and granted the same and
oriered that such election be held on the 23rd day of November, 1940, end that~the County
Judge of Kerr County issue sn order therefor and cause public notice thereof to be given as
required by law.

This 14th day of October, 1940, came on to be opened and tabulated by the Court the retur
of the Special Election held in Justice's Precinct No. 2 of Kerr County, Texas, on Saturday
September 26th, 1940, end declaring the result of said election to determine whether or not
Beer containing alcohol not exceeding four (4~0) per centum by weight may be legally sold Sn
seid Justice's Precinct S:o. 2 of Kerr County, Texas, and the Court having canvassed the return
cf seid Election which election was held according to law, and it appearing that a majority oP
t=° votes polled at said election were cast "against prohibiting the sale of beer containing
alcohol not exceeding four (4y`p) per cent um by weight" in said Precinct, as shown on Page^23,~~
Vol. 3, oP the Record of Election Returns of Kerr County.
It is therefore ordered, adjudged-end decreed by the Court that the sale of Beer contain-
ing alcohol not exceeding four (40) per centum by weight with said Justice's ~preeinet n*o. E of
Kerr County, Texas, be and is hereby allowed until such time as the noel if led voters therein
may hereafter at Lhe legal election held for such nurcose by s majority vote declde~~otherwise;
