4th. The height oY the new dam in the current or center of the river 1S to be the eeme
height ae that of the present dam, but the height at each en d of the dam shall be 8 inch as
~ higher than in the oanter as may hereafter be determined by J. M. He hb after making proper
measurements and taking observations. The new dam shall be set back Yrom ,the present dam
a uniYorm distanoe of 35 feet.

first part and the same shall be maintained and ketp up free Yrom coat or expense to the
party oY the second part.
6th. In addition to the material hereinb ofore ep ec ified for the erection of a new dam to

a to furnish a euYYioient amount of Dement to make the poste in said dam reasonably seoure
in their sockets and to proteot said dam, at the bottom thereof,~from unreasonable and
unnecessary leakage.
This oontraot is eub~eat to the approval oY the Commissioners' 6o urt and one copy
the roY shall be flied end reoorded in the Minutes of said Court.
