Jnnotloa Highway, at~ a point about one mile west from Ingram and through the land oP Bfi1sa
Sue Rob ineon, and the pet itionere being present by attorney and the eaid Miea Sue Robinson
being before the court in person and by attorney contested the said rap ort of the said
Bury of view. and the said Ddi ea Sue Rob ineon did in open court agree, that iY the court
would accept the road heretofore opened under an order made Dy this Court at the November
Term, 1924, of this court, and not open another road sa petitioned Yor, that she would,
at her own expense, so distribute the grade oY the eaid road and ao reduce same that the
grade oP the eaid road shall at no part or portion of She same between the Old Junction
road• and the New Highway, be a grade oY in esoesa o! 1291, and Yarther agreed that the Bald
road as re duped in grade shall not be narrowed Dui shall be of a width not lase than~the
road sa now made, and further that she will ao distribute and diepeae oP the materiel
taken Yrom the grade is reducing same ae to make ae good a road bed ae reasonably praoti-
oable with the material eo taken out, and to take Data as wall ae may be done oP the water,
so as to prevent the washing oY the eaid road Ded.
The Court having considered the eaid proposition by oonteatant, St Se ordered that same
be accepted, and that this cause be continued until the next term hereoY 1n order to permit
the eaid Miee Sue Robins on to comply with her agreement to redone the grade of the eaid
read, with the understanding that when she has complied with her agreement sa above sat
out, that the eaid road will be sooep tad and the petition now and ar coneid Brat ion herein
will be overruled and dismisned.
The oertlf ioate of J. b. McCreary, m. L. Statkpy and J. C. Yoary to the fact that the
grade has been reduced in compliance with the above agreement shall be oonoluaive as to
that question.
