to open s publio road from the old Kerrville & Junotlon Highway to the new Kerrville end
Jnaotion Highway, at. s point about one mile west Prom Ingram and through the land of Mies
Sue.Robinaon, and the petitioners being present by attorney and the said Mine Sue Robinson
being before the oourt in parson and Dy attorney contested the said rap art of the said
jury oY view. and the Bald Miae She Bobineon did in open oourt agree, that if the oourt
would aoospt the road heretofore opened under an order made by this Court at the November
Term, 1924, of this Dour t, and not open another road as pet it toned for, that she would,
at her own expanse, so distribute the grads of the said road and ao reduoe same that the
grade oY the said road shall at no part or portion oY the same between the Old Jun otion
road• and the New Highway, be a grade of 1n eaeeaa oP 12fi, and i4u~ther agreed that the said
road as reduoed 1n grade shall not be narrowed but shall be oY a width not lane than~the
road sa now made, and further that she will eo distribute and diepeee of She material
taken from the grade Sa reduoing same ae to make ae good a road bed ae rasa oaably prsoti-
oabls with the material eo taken out, and to take Dare a9 well ae may be d ono of the water,
ao as to prevent the washing oP the said road bed.
The Court having aoneidered the said prop osltion by oonteatant, it is ordered that same
be sooepted, and that this oauee ba oontinued until the next term her eoi in order to permit
the Bald Mine Sue $obineon to Damp ly with her agreement to reduoe the grade oY the said
read, with the uadaret and ing that when she has oomplled with her agreement as above net
out, that the said road will be saoeptad and the petition now and ar conaid oration herein
will be overruled and diamieaed.
The oertifioate of J. E. MoCrsary, tl. L. Starkly and J. C. Yeary to the Ysot that the
grads has been reduoed in oomplianoe with the above agreement shall be oonolusive as to
that question.
