Kaiser the sum of $250.00 ae damages and oompeneation for land taken as right of way of Highway Ro. 41 eorose said Kaiaer~s land, and a sum not to axosed X700.00 to pay the additional cost of erecting a larger aonorete stook pass connecting said Kaisers pastures on both aides of said highway, and It further appearing to the Gourt that thereafter a large concrete etoak pass was oonetruated at station 961 x 30 on said highway, according to epeoifioationa required by Frank Hatch lessee of said Kaiser~a ranph, the additional cost and expense incurred to Kerr County for enlarging said stook pass being $430.38, leaving a balance of $262.22 unused of said $700.00 allowance, and whereas, Kerr Covnty has agreed with the property o~mers along said Highway to contribute $200,00 per mile of fanoing erected by each of said own ere, and 1Riereas, said A. D. Kaiser, F. H. Cobb end Frank Hatch have proposed to the Court to accept in full sad final settlement of all their claims for damages, 'ointly and indivlfl- uslly, against Rerr County by reason of the oonatruation of said Highway Ro. 41 eorose the lands formerly owned by said Kaiser and now owned by said F. H. Cobb, said $250.OO,to be paid A. D. Kaiser, and acid X262.22 balance unused stook pees appropriatioa,to be paid F. A. Cobb, said soma of money to be in addition to the $200.00 per mile for fencing; and it appearing to the Court that the aooeptanoe of said proposition is to the best interest of Kerr-County and the general publlo, upon motion duly made, seconded and adopted, said proposition be anfl is hereby accepted by the Court, and the County Treasurer of Karr County is hereby authorized to pay unto said A. D.
