& Company of Kerrville, Tezas, for the construction of approaimately 2-3/4 miles of road con-
necting State Highway No. 16 and the Bandera Road beyond the Ste to Park, end the re-coadition~
ing and improvement of that portion of old Highway No. S1 lying between Highway No. 18 and thi
Guadalupe River, at a coat of X44,019.58, the payment of whioh 1s to be made by the issuance
of $44,000.00 of Kerr County Road do Bridge Improvement Warrants, bearing interest at the rate
of 54 per annum from May 10, 1937, interest pays ble annually, said warrants being numbered
from 1 to 44 inclusive end being due and payable on a beaie of #4,000.00 per year beginning
May 10th., 1942;- we, the Trustees of the said Charles Schreiner Road Fund do hereby obligate
sad Dind ourselves as Trustees and our aucoesa ore Sn Trust, to assume the payment of ell of
the interest to become due and payable on se id $44,000.00 of road cad bridge warrsata, on end
after May 10th, 1942, and do further bind and obligate ourselves ae auoh Truataea and our
successors Sn Trust, to asavme the payment of seventy-five (75) per cent of the principal sum
of said road cad bridge warrants to become dun and payable on sad after May 10th, 1942.
This agreement being entered into with the ezpreas and explicit understanding that
Kerr County is to pay ell interest to become due and payable on said Road and bridge warrants
up to and including May 10th, 1941, cad twenty-five (25) per cent of the principal sum of said
road and bridge warra nta as they beaome due and payable on end after May 10th, 1942. Kerr
County shall have the privilege and right to take up and pay off its 25$ of said principal or
any Part thereof in multiples of $1,G00.00 eaoh, et any maturity date of said warrants.
This oontract and agreement to become effective only upon its approval and acceptance
by Kerr County, and then to~be recorded in the minutes of the Commisa ionera' Court of said
County.

~, WHIItEAS, the saifl County of Kerr, known ee the party of the first part, desires to
enter into contract for Lhe Smpr ovement of State Perk Road in Kerr County, commencing at
Station 0{00 in Handers Road and eatending thanoa to Station 141}10.4 connection with State
Highway No. 18, or ea far ea the money available will construct in accordance with the
ptovisions of the ate to Statutes end of the proposal attached, and plans and speciPi cations
agreed upo~,end signed for identification, end made part hereof, end ~ ~~
WHEREAS, the party of the second part has been engaged in and now does suoh work and
represents that he is fully equipped, competent, and capable of performing the above desired
end outlined work, end is reedy and willing to perform such work in accordance with the
provisions of the said proposal attached, end plane end specifioationa agreed upon and signed
for identification, now
WITNESSETH: That for and in consideration of the prices and agreement mentioned in the
proposal hereto attached and made part of this contract the said contractor agrees to do,
at his own proper cost and ezpense, ell the work necessary for the improvement of State
Park Road in Kerr County, in accordance with the provisions of the proposal attached., and
plena and specifications agreed upon end signed for identification, which are made part of
this contract, and in full compliance with all of the terms of the apeoifioationa and the
requirements of the County Engineer.
The said contractor further agrees to begin the work on or before Map 24, 1937, end to
complete same in 90 working days.
And said County of Kerr, in consideration of the full and true performance of the said
work by said contractor, hereby agrees and binds itself to pay to said contractor the prices
set Yorth in the attached proposal, and in the manner provided in the said specifications.
The contractor expressly warrants that he hen employed no third person to solicit or
obtain this aontract in hie behalf, or to cause or procure the same to be obtained upon
compensation in any way contingent, in whole or in part, upon suoh procurement, and that he
has not paid, or promised or agreed to pay, to any third person, in consideration of such
procurement, or in compensation for services in connection therewith, any brokerage, commis-
sion, or percentage upon the amount receivable bq him hereunder; and that he hen not in
estimating the contract price demanded Dy him, iaoluded any sum by reason of any such
brokerage, commission or percentage; and that all moneys payable to him hereunder are free
Prom all obligations of any other person far services rendered, or supposed to have been
rendered, cn the procurement oP this contract. He further agrees that any breach of this
warranty shell constitute adequate cause for the annulment of this contract by the party of
the first part, and that the party of the first pert may retain to Sts own from any sums
due or to become due thereunder en amount equal to anp brokerage, commission, or percentage
so paid or agreed to be paid,
