D. 1940, came on to be heard and considered the application of the City of Kerrville, for the right to lay Water and Gas Lines Prom the City Limits to the Scott Schreiner Homestead located on the Harper Road or Highway, said Water and Gae Line to be layed on the North East side of the Harper Road, in the ditch, with the express underatanding thgt the City of Kerrville agre as to be responsible for any and all damages to the Road or Ditch involved to ley its water and gas lines. The City of Kerrville Pur they ,agrees to be responsible for any and all damages that may aoarue to any private person or Sdo persons by reason of the laying of said lines and absolves Kerr County of any and ell damages that may ever arise by reason of the laying of said lines. Schulze for the execution and delivery to him by Kerr County of a qult-claim deed covering a strip oP land described as follows, to-wit: All that certain tract or parcel of land lying and being situated in the County of Kerr, State of Texas, on the waters of the Guadalupe River out of original Survey No. 70, Sn the name of W. T. Crook, and being the S. W. end of that strip of land conveyed to the County oP Kerr, by deed oP record in Vol. 34, Page 533, Deed Reoards oP Kerr County, Texas, described by metes and bounds as follows, torwlt :. Beginning at the South or ~. E. corner of said Sur. No. 70 on the river bank. Thenoe N. 45 E. 93 varas with 5. E. line of said Sur. No. 70, to a large L. 0. tree marked _ at 141 varas Por corner.
