Catz, Piled with the County Clerk on June 25th, 1941, asking the Court to establish a Second Class public road 38~ feet in width from "ell that certain strip of land, 36~ feet wide, lying and being situated in the County of Re rr, State of Texas, out of original Survey No. 120, in the name of Walter Fosgate, end out oP that tract oP land conveyed to G. C. McCoy by Wehrmund Estate by deed of record in Yol. 62, page 358, deed records of said County. The Center line of said 36~ foot strip begins at a point in the 381 N. E. line of the Harper Road, set 228} feet N. 45° W. from the South corner of a 20 sore per- eel mentioned in the Wahrmund Estate. Thence N. 45 E. 300} varas corner. Thence N. 55 E. 23 varas corner. Thence N. 62 E. 274.20 varas. Having a wl dth of 1H} Peet on each side of this center line. From this point on with a strip the same width the center line begins at the end oP the above center line, running N. 47 E. H4~ varas and N. 36~ E. 94 varas to the end of thls road., in Precinct No. 1 of Kerr County, Texas, and it ap peering to the Court that proper notices of the filing of said petition were legally posted at three public places and for the length of time required by law, and that no ob~eotion has been made to the Court to the establishment of seld road, and that all the lend owners over whose property eai d~road run have agreed to donate the required right of way therefor and are waiving all olaima for damage that may be incurred by the establishment of said road.
