It is agreed Dy Commissioners' Court of Kerr County, Texss, in connection with the property of
Mr. A. H. Herdir., located on the North Fork Road in the vicinity of Hunt that:
(1) That portion of the right-of way where the present windmill eat~nds into said right-of-
way is to be rrotected and the windmill leg and foundation Ss to remain intact and is not
to be disturbed; and further, shoul3, et any time for any resaon, the foundation be demag
ed or the windmill impaired for any reeaon, %err County will rerlace the same in good wor
manlike manner and at least es good es it is et this time, to assure a foundation for the
Lower end the proper operation of sa ld windmill.
(2) Thet it is further agreed that Kerr County will protect end stand the expense of ereoting
walls, dykes, and such other structures es :uey be necessary to prevent the contem ination
