Th 1s Lhe 17th day of May, A. D. 1950, by motion duly made by Eokatein, seconded by Powell
and unanimously approved by the Court, with Furr absent at the time of vote, that the following
agreement ba accepted in regard Lo Farm-to-Market Right-of-Way No. 1340, Lo-wit:
It is agreed by Commisslo ners' Court of Kerr County, Taxes, in connection with the property oI
Mr. A. B. Hardi ., located on the North Fork Road in the vicinity of Huht that:
(1) That port iun of the right-oP way where the present windmill extends into said right-of-
way is Lo be ,.rotected and the :vindmill leg and fo undetion is to remain intact and is not
to be disturbed; end Further, should, et shy time for any rec;son, Lhe foundation be demag
ed or Lhe windmill impaired for any reeaon, Kerr County will reilace the same in good wor
manlike manner and at least es good es it is et this time, to assure a foundation for the
tower and the proper operation of said windmill.
(2) That it is Further agreed that Kerr County will protect and stand Lhe expense of erecting
walls, dykes, and such other structures as may be necessary to prevent the contamination
or injury to the well proper caused form the flow or overflow of surface water running
along the borrow ditch of aeid right-of-way.
(3) Kerr County further agrees that the cattle g;oard belonging to Mr. Bardin shall be left
