agreement be accepted in regard Lo Farm-to-Market Right-of-way No. 1340,to-wit:

consideration of the granting to Kerr County and the State of Texas of the right-of-way describ
ed and designated on a carte in map prepared by the State Highway Department in connection with
the ophstruc tion of whet is oommoaly known as the North Forffi~ Road from Hunt to Mo-Ra ne h, Ferm

(1) The Cattle guard belonging to Mr. Wootten shall be left intact as now situated and she uld
it be necessary at any future time to move or de:atroy the approaches, wells, and/or winga
of said cattle guard es now nit us tad, that Karr County will, at Sts own ea,~anse, move said
captie guard and wings is exactly the same condition ae it is now constructed and replace
said cattle guard and walls, wings, and other appur tens ncas thereto in et least as good
condition as the same now is.
(2) It is further agreed that Eerr County will move the present fence situated upon the prop-
erty owned by the ae i3 Virgil E. Wootten and rebuild the same oh the new right-of-way line
without coat to the sa Sd Virgil g, Wootten and w7.11 replace the same in at least as good
condition as it presently is, in its new location.
This agreement shall be bind lag upon Kerr County and the said Virgil E. Wooten, his he ire and
assigns forever.
