THIS AGREEMENT, made this 12th day of June, 1950 by and between Kerr County, Texas,
hereinafter called the "County", Party of the First Part, acting by and through its Commissio
ers' Court and the State of Texas, hereinafter called the "State", Party of the Second Part,
acting by and through its State Highway Engineer.
WHEREAS, the County has requested the•State to include in its plans the installation oY
Elva (5) cattle guards located on F. M, Highway 1340 and the State has agreed to this on con-
dition that the County will reimburse the State for the total cost thereof, and
WHEREAS, the County is to pay the total cost of the construction of these cattle guards
including engineering and contengencies items and it is estlmated the County's share of the
cost of this improvement is Three Thousand Seven Hundred and Fifty Dollars ($3,'J50.00).
NOW THEREFORE, it is understood that this proposed work will be constructed in accordant
with the plena and the County will transmit to the State, with the return of this agreement
executed by the County, a warrant made payable to the State Treasurer Account of Trust Fund
No. 163 in the amount oŁ Three Thnnsaad Seven Hundred and Fifty Dollars ($3,50.00) to be used
in paying for the proposed work consisting of the installation ~of five (5) cattle guards loc-
ated on F.M. Highway 1340. It is further understood that the State will construct only those
items for the County which are included in the plans and all other items of work required by
the County and not included in the plans will be constructed by the County and the entire cost
of such items will be borne by the County. If upon receipt oŁ bids by the State and/or the
actual construction or approved changes in the contemplated improvements if is found that this
amount is in sufficient to pay the County's portion, then the County upon request of the Stat
will forthwith supplement this amount by and amount equal to the County's full share of the
cost of this work less the amount previously paid to the State. In the event the amount as
paid to the State is more than the actual cost, than the excess amount will be returned to the
County. It is understood that the work to be done on behalf of the County as herein provided
will include the cost of engineering and contengencies items.
IN TESTIMONY WHEREOF, the parties hereto have caused these presents to be executed
in duplicate on the day above stated.
