ment for the erection of five cattle guards located on FM Rwy y1341, which agreement is ea

THIS AGREEMENT, made this 22nd day of January, 1951 by end between Kerr County, Texea,
hereinafter called the "County", Party of the First Fs*t, acting by end through Sta Com-
miasionera' Court and the State oY Tezas, party oP the Second Pert, acting by end through
its State Highway Engineer. ~

WHEREAS, the County has requested the State to include in its plane the inn tallati on
of five (5) cattle gee rds located on F. M. Highway 1341 and the State has agreed to this on
condition that the County will reimburse Lhe State Por the total cost the*eoP, and
WHEREAS, the County is to pay the total coat of the construction oP thane cattle
guards Sncl ud ing engineering end contengenci as items end it is estimated the Couhty's share
of the cost oP this improvement is Four Thousand Dolls ra ($4,000.00).
NOW, THEREFORE, it is understood that this proposed work will be constructed in accord-
ance with the plena, end the County will transmit to the State, with the return of Lhis
agreement executed by the County, a warrant made pays ble to the State Treasurer Account of
Treat Fund No. 163 in the amount oP Four Thousand Dollars ($4,000.00) to be used in paying
for the proposed work consisting of the installation of five (5) cattle guards located on
F. M. Highway 1341. It is further understood that the State will construct only those
items Por the County which ere included in the plena and all other work required by the
County and not included in the plena will be constructed by the County and the entire cost
oP such work will be borne by the Gounty. If upon receipt oP bids by the State end/or the
a ct eel construction or approved changes in the contemplated improvements, it Ss Pound that
this amount Ss inauPf icient to pay the County's portion, then the Gounty upon request of
the State will forthwith supplement this mount by an amount equal to the County's Yull
share of the coat of this work less the amount previously paid to Lhe State. In the event ~ ~,
the amount es pe id to the State is more tHan the actual coat, then the excess amount will
be returned to the County. It is understood that the work to be done on behalf oP the
