Rodgers and others to establish a 3rd class road and the court having duly weighed and considered all of the evidence presented by both sides and the Jury of View's Report, the court hereupon determines that at this time said application for a 3rd class road shall not be approved, and is hereby dismissed in its present form; that the County Clerk is hereby direct- ed to draw vouchers against the County Treasurer payable to the Jury of View according to law.
