This the 8th day of December, A. D. 1952, came on to be considered by the court article 39128, Section 1 to 6 inclusive, Revised Civil Statutes of the State of Texas, which author- izes the Commissioners Court, when in their judgment, the financial condition of the County and the needs of the officers, deputies, assistants and clerks of any district, county, or precinct, officers justify an increasing in compensation. ~Plherefore the court is of the opinion that all elective officers' compensation could be ^i increased not to exceed 25%, and the deputies, assistants and clerk' compensation could not exceed 35%, based on the salary allowed under the law for the fiscal year of 1948, whether paid on a fee or salary basis; provided however, the members of the Commissioners Court may not raise the salary of any such Commissioners Court under the terms of this act, without raising the salary of the remaining county officers in like proportion. It further appearing to the court that the 1952 and 1953, budget was prepared for the allow an ca of this increase and that it is the requirement of this article that a notice be published under the direction of the Commissioners Court of their intention to make changes of salaries and that such date of hearing should be on Monday, January 12th, 1953, at 1G:00 o'clock A. Io., and that this notice be published in both newspapers of Kerr County at least once a week for three con- secutive weeks.
