APPROVAL OF LEASE CONTRACTS "dITH N100NEY AIRCRAFT, INC. This the 10th day of January, A. D., 1953, came on to be considered by the court the lease contract and contract for option to lease additional twenty acres for a term of fifty years, hoth of which contracts are in regard to the Louise Schreiner Field, Kerrville ik~unicipal Flying Service, and the City Council of Kerrville with the Niooney Aircraft,Inc. Wherefore the court is of the opinion that it would be beneficial to Kerr County as a whole to lease the "' premises as set out in said contracts and that each should be approved at this time. `Therefore motion duly made by Guthrie, seconded by Partel and unanimously approved (Commissioner Fowell being ahsent) that Kerr County enter into the two contracts a copy of each being entered herein to-wit: "STATE OF TEXAS: COUNTY 0 F KERR: This MEMORANDUM OF CONTRACT made and entered into this 8 day of January, A. D. 1y53, by and between Kerrville Flying Service, a 'Texas Corporation, hereinafter called Farty of the First Part, AND Niooney Aircraft, Inc., of '~:ichita, Kansas, hereinafter called Party of the Second Part, VIITNESSETH: Party of the First Part does hereby agree to lease and Party of the Second Part agrees to take the following described premises to-wit: One (1) metal clad Aircraft Hanger, 13G x 160 feet, and the south wing of the Administration Puilding, which includes one (1) office space approximately 20 x 60 feet in size and two (2} rest-rooms thereto attached. All of said pre- mises being located in Kerr County, Texas, on what is known as the Louis Schreiner Field Kerr- ville Municipal Airport, about five miles S. E. of the City of Kerrville, Texas, together with an option to lease approximately twenty (20) acres of vacant land on said Municipal Airport, aL such location as the parties hereto may agree upon, at the time of the exercising of said option. If said option is exercised, then the rental on said twenty (20) acres of land, more or less, shall be "'1.00 per year. TO HAVE AND TO HOLD the said premises hereby demised unto the Party of the Second Part from the 1 day of February, 1953, or as soon as said buildings are ready for occupancy (heating plumbing, power, etc., installed) to the 1 day of February, 1y58. The consideration shall be the sum of Twelve Thousand & No/100 (~12,000.hO) Dollars, or so much thereof as shall become due as hereinafter set forth, payable as follows, to-wit: The sum of .w2GU.U0 to he paid upon the execution of this Contract which shall be the rental :for the first month of occupancy, the receipt of which is hereby acknowledged and confessed and a like sum of ~200.GU to be due and payable on the lst day of each and every month thereafter, until the expiration of the term. The City of Kerrville, Texas and Kerr County, Texas, being the owners of the land and ~_~ premises hereinabove subleased by Kerrville Flying Service *o Mooney Aircraft, Inc., does hereby ratify and confirm the above contract and declare the same to be in a1:L things in accord- ~ ante with the understanding between the said City of Kerrville, Texas, Kerr County, Texas, and their Lessee, the Kerrville Flying Service. It is especially agreed and understood that the lease of the premises hereinabove describ- ed, is for the sole and only purpose of the manufacture, design, modification end storage of aircraft, aircraft components and parts, or the manufacture, modification design or storage of Flying Targets or Guided Missals, components and parts. Party oP the Second Part, covenants that it will not make or allow to be made any unlaw- ful, improper or offensive use of said premises. Fartv of the Second Part covenants not to make any major alteration or addition to the premises herein leased, without the consent of Party of the First Part, the City of Kerrville, Texas, and Kerr County, Texas, being thereto first obtained in writing. Party of the Second Part, will at the expiration of the term of this lease, peaceably ,yield up to Party of the First Part, all and singular the premises in good tenantable repair ,., in all respects, reasonable use and wearing thereof and damage by accidental fire or inevitable accident only excepted. Provided, always, and these presents are upon this condition, that if Party of the Second Party does not or shall neglect or fail to perform and observe any or either of the covenants contained in this instrument which, on the part of the Party of the Second Part, are to be performed, or shall be declared bankrupt according to law, or if any assignment shall be attempt- ed to be made of said property for the benefit of creditors, then, in either of said cases, the Party of the First Part lawfully may immediately or at auy time thereafter, and whilst such neglect or default continues, and without further notice or demand, enter into and upon the said premises or any part thereof in the name of the whole and repossess the same as of his former estate, and expel the Party of the Second Part and remove Party of the Second Part's effects (forcibly, if necessary) without being taken or deemed guilty of any manner of trespass, and without prejudice to any remedies which might otherwise be used for possession or for arrears of rent, and that upon entry as aforesaid the rights or Party of the Second Part in this ..t lease, shall cease and be ended. This contract is subject to rights of the United States Government to make exclusive use of said Airport during a major national emergency. This contract is performable in Kerr County, Texas. Leavell County Judge" This is a memorandum of an option to lease, entered into this 8th day of January, 1953, by and between the City of Kerrville, Texas, and the City of Kerr, Texas, both acting throng h the proper officers, hereinafter called party of the First Part, and Mooney Aircraft, Inc., of Wichita, Kansas, hereinafter called party of the Second Part; WITNESSETH: The party of the First Part does hereby agree to lease unto the party of the Second Part for a term of fifty (50) years from date, approximately twenty (20) acres of land out of the Louis Schreiner Airport, Kerr County, Texas, at an agreed sum of one dollar (~1.U0) per year, with the understanding and agreement that the party of the Second Part, as a part of the con- sideration, will operate a business for the manufacture, design, modification and storage of aircraft, components and Harts or the manufacture, modification, design or storage oP Flying Targets or Guided Missiles, components and parts, on said approximate twenty acres of land or in other facilities located at said Airport. It is the further agreement of the parties hereto that said party of the Second Part shall have a right to select any approximate twenty acres of land within the Louis Schreiner Airport, Kerr County, Texas, so long as the same does not in any wise prejudice the rights of, and shall be agreeable to, the Kerrville Flying Service, a corporation, any existing lessee and the part- ies hereto. It is further agreed that in the event the said party of the Second Part shall not i9o business on the property of the Louis Schreiner Airport as herein stated, or shall discontinue said busiaess, then in either event, this option shall be null and void and any lease contract entered into by the parties shall terminate within six (6) months from the removal or dis- continuance of said business of the party of the Second Part. It is further agreed that this is an option to lease approximately twenty acres of land out of the Louis Scheeiner Airport, and is not a lease, and that such option shall continue from date for a full term of five years, or until the party of the Second Party shall move from said Airport or discontinue to do business on said Airport property, for a period of six months, whichever is the sooner. It is further agreed that in the event the party of the Second Part shall lease said app- roximete twenty acres of land and build any buildings upon the same, all buildings constructed upon said land shall be constructed so as not to interfer with aircraft safey as prescribed by the Civil Aeronautics Administration. It is further agreed that any lease contract entered into by the parties hereto shall be subject to the rights of the United States Government to make exclusive use of said Airport ~.~ during a major National emergency. It is f urther agreed that all money due under any lease contract shall be payable in Kerr County, Texas.
