D. 1953, came on to be presented to the court, an easement presented by the Lower Colorado River Authority to be executed by Kerr County, when taken in connection with an electric right-of-way easement across the property of the Nichols Cemetery located in Survey 126, in the name of R. Nichols. It appearing to the court that said ceruetery property was conveyed to Kerr County by three conveyances as mown of record in Volutue S page 493 from J. L. Nichols; Volume 55, pa€e 417 conveyed by the Nichols heirs to Kerr Count y, and Volume 55, page 177, being a conveyance from Homer Rudasill, and wife, to Kerr County. ";herefore the court is of the opinion that title to such ceruetery is still in the name of Kerr County, and that in order to furnish electricity to the caretakers' property, it will be necessary that this court authorize the County Judge to execute an easement in favor of said Lower Colorado River. D. 1953• COUTITY OF KERR: This the 16th da,y of January A. n. ].953, came on to be considered by the court the pro- visions of Senate pill ,;r5, Chapter 465 passed at first called session of the 44th Legislature prescribing compensation of District, County and Precinct officers to be compensated on a fee basis and be allowed to retain the increased maximum as contemplated under Article ~3G'';la R. C. S. which also includes the increase co:nnensatien for the deputies for sucrr various officers and the provision of Article 3912e, Section 2, F:. C. S. prescribing that the Peace / Officers be compensated on a salary basis, according to the provisions of H. J. h. #,36 of the Seth Legislature as adopted by the people in the Eeneral election of November 2, 1945, amending Section 61 of Article 16 of the State Constitution as the same applies for the payment of salary of Sheriff and Con ^tahles in counties having a population of less than 2C,(,UO.UO. `~";hence the court had published in two newspapers of the Count;; of Kerr, for three (3) consecutive ~.veeks, the provisions under and by autlrority of Article 3;12, Section 1 to 6 inclusive, R. r„ S., when in the judgment of the Commissioners Court, the financial condition. of the County and the reeds of the officers, deputies, assistance and clerks of any district, county or precinct officers, justify an increase in compensation, elective officers not to exceed 25%, and the deputies, assistants and clerks not to exceed 35~,each of such categories being allowed suds increase teased on the salary allowed under law for the fiscal year of 1945, whether paid on a fee or salary basis, provided, however, the members of the Commissioners' Court may not raise the celery of any such Commissioners' Court under the terms of this act without raising the salary of the rer:~aining county o°ficers in like proportion.
