- No. 5938. REPRESENTATIVE JOE BURKETT, JR. AUTHORI`LED TO INSTITUTE LEGISLATION FOR CITIES AND }^ COUNTIES TO ASSIST IN ERECTING PUBLIC LIBRARYS AND AUDITORIUMS. I This the 24th day of January, A. D. 1953, came on to be presented to the court by W. G. Garrett, Jr., City Councilman and as Trustee of the estate of Walter Jarmon, deceased, with a proposition that the City of Kerrville end Kerr County, might authorize StatŪ Representative Joe Burkett, Jr., to make preliminary study and institute legislation for an act which would authorize cities and/or counties to assist in the building of Public Librarys end/or audito- riums, and that such governing bodies be so authorized to issue bonds for the cities and/or counties, so desiring to errect any such public buildings, after having received signed pe- titions of a certain per cent of the tax paying citizens within such vicinity, so requesting the governing bodies to call an election to determine whether the public is in favor oP, or against such proposition to expend funds or to authorize a bond issue for the erection of a public building to be used for a library and/or auditorium. Wherefore, the court was further informed by the said W. G. Garrett, Jr., that the estate of Walter Jarmon has bequeathed and devised to VJ. G. Garrett, Jr., et. al, Trustees for the use and benefit of Kerr County War ~"^ Memorial Association, certain real estate located on Main Street in the City of Kerrville, and that there is on hand at the present time approximately $38,000.00 with the aforementioned fund and that if the City of Kerrville and Kerr County could be authorized to erect financially for such construction of a public building, this War Memorial Fund would furnish the site for such erection and donate the approximate X38,000.00 on hand, to apply on the furnishings there- in. The court having conferred with the City representatives in open court and reached an agreement, that if proper legislation could be instituted to allow cities and counties to erect buildings of this nature, both governing bodies would participate in whatever legislation that could be enacted. The court is of the opinion that State Representative, Joe Burkett, Jr., be so authorized and/or instructed to make any preliminary study and institute legislative enactments that would assist any governing body or bodies to expend funds or issue bonds, Por the assistance on the erection of any public building to be used in such capacity. Therefore by motion duly made by L. M. Guthrie, seconded by Lee Goff, and unanimously approved by the Court, that Joe Burkett, Jr., be instructed to make preliminary study and present any legislation for enactment, before the present legislature, authorizing any city or county to erect any building for a public library and/or auditorium with public funds, and that such governing bodies if need be, be authorized to call for an election either at the discretion of said governing hodies, or by a petition of a certain percentage of the tax pay- ing citizens of such city and county requesting such governing bodies to call an el action for the purpose of levying a tax to determine whether the public is in t'svor or against any such proposition, o-o-o-o-o-o-o-o-o-o '1'he follow' g minutes from page 117 to 135 exclusive, were read in open court and found to be correct a re hereby ap rove this 9th day of February D. 1953.
