Second party agrees to pay first parties, the sum of X200.00 per acre for said land, which a-nounts to X1,189.60. IV. In addition thereto, as a part of the consideration for the execution of said deeds, the second party has agreed and by these presents do hereby agree to erect a good and sufficient fence along the right of way of said new highway, on the West side thereof, on the division line between said right of way line and the first parties property; said fence to be woven wire fence of heavy guage, of 12" mesh, vaith heart cedar posts, 5 and 6" tops, to be spaced 21 feet apart, with three staves in between said posts, and tyro barbed wires at the top thereof, and one barbed wire at the bottom; said fence shall be erected tefore said highlvay is built so that the first party may have a complete enclosure to protect his livestock from straying from his property; said fence to be started right away. V. As a further consideration, second party agrees that they vaill construct, at the County's expense a cattle guard at the East end of the old Farm to ;.:arket Eighway No. 689, where it enters first parties property on the East side thereof; said cattle guard to be built o:f Rail- road rails lamed lengthwise vrith said highway, spaced 9" apart, with 70 lb. airplane mat welded on top thereof; said county caill further erect another cattle guard of the same kind and char- acter on the 'lest end of said road, vahere it enters the first parties property from the :'lest side thereof; said cattle guards are to be built v;hen the neva road has been completed and traf- fic directed over the same, s0 that the erection of the cattle guards will not obstruct, or in any vaay interfere with traffic on said highway. ~7ITNESS CUR "t~AT~DS, This 1st day of June, A. It appearing to the Court that such auditor's report should be _ accepted and his fee covering his services in the ar.~unt of 'j1500.00, should be al_lovaed out of the General Fund of Kerr County, Texas. Therefore, by motion duly made by Goff, seconded by Guthrie, and unanir_ously approved by the Court, that the audit of `,gin..
