FINAL SETTLEMENT FUR DAiAGES FOR HENRY BL02e'! AND "v'v'IFE. This the 27th day of August, A. D. 1953, came on to be considered by the Court, the willing- ,- ness of Henry Blom and wife, P.4ay Etta Blom, to accept the ,5,000,00 damages and ,87.00 for the .745 of an acre used on right of way for the Kerrville-Ingram Highway IQo. 27. It appearing to the Court that an offer was made by this Court to allotiv the aforementioned amounts on August 19th and that the following agreement should be entered into between both parties herein. Therefore, by motion duly made by Goff, seconded by Guthrie, and unanimously approved by the Court that the following agreement be entered into by the Commissioners' Court and Henry Blom and wife, and the County Clerk and County Treasurer be, and are hereby directed to dray voucher in the amount of X5087,00, payable to Henry Blom and ",vife, P,4ay Etta Blom, out of Kerrville-Ingram, R. & B. R. ;Y, Fd. Highway 27. The agreement entered as follows, to-vrit: "THE STATE OF TEXAS O 4 COUi`iTY OF KERR ~ KnT0i7 ALL ?.'EN BY THESE PRESEDITS: This memorandum of an Agreement this da_y iriade and entered into by and between Kerr County, Texas, acting herein by and through it's duly authorized Commissioners and County Judge, sitting session of Commissioners' Court, hereinafter called party of the First Part, and Henry Blom and .-- wife, D:ay Etta Blom, of Kerr County, Texas, hereinafter called Parties of the Second Fart, 'dIT- NESSETH: "7HEREAS, The County of Kerr, State of Texas, has this day purchased from Henry Blorr: and wife, t,?ay Etta Blom, a strip of land 30 feet in width of the extreme South side of Henry Blom's property for road purposes, same being for the purpose of widening the existing road now adjacent to said property of Henry Blom and has agreed to pay to the said Henry Blom therefor the sum of x'5,087.00. A_ND, ;+1HEREAS, there is now situated on said property trees, shrubbery, fences and a portion of a dwelling house, together vrith other improvements, which a_re not included in such sale_ the said Henry Blom shall have the privilege of removing from said premises all improvements situated thereon at any time prior to the 1st. day of April, 1954, and he, Henry Blom, shall have until the 1st. day oP April, 1954, in which to remove said ir,,provements from said premises. And if said house and improvements located on said strip of land are not moved therefrom by the said „_ Henry Blom by the 1st. day of April, 1954, then the County shall have the privilege of go in in • and at it's ovm discretion moving all said improvements; and arty portion of the house then re- maining on the land so conveyed to the State may be removed by the State of Texas or County of Kerr at the expense of the said Henry Blom and shall not be held responsible to P. Blom for the destruction of any of those improvements remaining on said land, this day so conveyed by the said 2~0 Henry Blom and wife, Iaiay Etta Blom, to said State of Texas, as aforesaid. It is mutually agreed by the parties hereto that all conditions and stipulations hereinabove ^ set forth sahll be applicable only to that 30 foot wide strip of land deeded to the State by the said parties of the Second Part of the south side of said Henry Blom's property, said strip con- taining approximately .146 acres of land, and shall in no wise affect a ny portion or improve- ments on the land remaining in the name of Henry Blom adjacent to this strip so deeded to the State of Texas. D. 1953, against the General Fund and R. ~. B. ~r3. It appearing to the Court that said claims are true and just and should be allowed out of the respective funds. Therefore, by motion duly made by Bartel, seconded by Goff, and unanimously approved by the Court, and the County Clerk be, and is hereby directed to draw vouchers against the County Treasurer on all claims filed in like amounts therefor, payable out of the respective funds to the parties entitled thereto.
