This the 23rd day of September, A. D. 1953, came on to be presented to the Court the
August food bill for the prisoners oP Kerr County, and the claim of James E. Nugent, County
Attorney, for services rendered in condemnation proceedings of J. 2~i. Stooksberry and R. b5. D'on-
tel in the amount of X150.00. It appearing to the Court that such claims are dust and should
be approved, out of the General Fund and R. & B. R. VJ. Fd. F. P.1. 689, respectively. Therefore,
by motion duly made by Powell, seconded by Guthrie, and unanimously approved by the Court, and
the County Clerk and County Treasurer be, and are hereby directed to draw voucher for each
claim as filed herein and out of the respective funds thereof.

This the 23rd day oP September, A. D. 1953, came on to be considered by the Court the nec-
essity to modify Commissioners' Court Order #6276, passed September 16th, 1953, for the purchase
of machinery Prom H. 'dJ. Lewis Equipment Company. tiNherefore, the Court is of the opinion that
such order should be modified directing the County Clerk and County Treasurer to draw voucher `~
in the sum of X5200.00 instead of $4200.00 out of the Road and Bridge Fund, for one rebuilt
Allis-Chalmers AD-4 motor grader, serial No. 2992, motor No. 4A-2120, with scarifier No. 1G-606,
with 104 h.p. G. M. Diesel engine, instead of one rebuilt Allis-Chalmers AD-3 motor grader serial
No. 1F-814, motor No. 371-22945. Therefore, by motion duly made bq Goff, seconded by Guthrie,
and unanimously approved by the Court, that Commissioners' Court Order No. 6276 be modified to
purchase one rebuilt AJ.lis-Chalmers AD-4 motor grader, serial No. 2992, motor No. 4A-2120, with
scarifier No. 1G-606, with 104 h.p. G. P,7. Diesel engine, and that the County Clerk and County
Treasurer be, and are hereby directed to issue check in amount of X5200.00 in favor of H. Vd.
Lewis Equipment Company, payable out of the Road and Bridge Fund, which amount shall be in the
place of the $4200.00 as set out under Commissioners' Court Order No. 6276.

AIMS REAL AND J. H. WARE PROPERTY.
This the 24th day of September, A. D. 1953, came on to be considered by the Court, the oral
agreement between E. A• Graham, J. H. dare, and L. A. Real, and a letter Prom G. C. T.Raddox, indi-
cating that the following parties desire to donate the aggregate of X8500.00, together with the
necessary right of way for the widening and straightening of the upper Turtle Creek Road, which
is an extension to F. TC. 1273, to commence at the cattle guard between the Joe Sid Peterson and
E. A. Graham property and extending in the opposite direction to the cattle guard between the
property of Aime Real and J. H. Ware. Wherefore the Court is of the opinion that J. F.. 7dare and
E. A. Graham have agreed orally to give the sum of X1000.00 and $3000.00, respectively; Louis
Real, Aime Real and Hugo Real have agreed orally to give the sum of X4,000.00, and G. 0. Maddox
has agreed by letter to give in like manner to Kerr County, the sum of X500.00. It appearing to
the Court that such donated money given to Kerr County should be 8ccepted for the specific pur-
pose of repairing the existing Turtle Creek Road between the points hereinabove set out and
wherever necessary, in straightening, building new, widening or in any other way improving the
upper Turtle Creek Road; in addition to the money hereinabove set out, the parties agree to
furnish to Kerr County, Right of VJay Deeds or Easements as they so choose, 40 feet in width
through the whole length of the reconstructed Turtle Creek Road, with the exception of the water
crossings, which shall be so wide as the Commissioner or County Surveyor shall deem necessary
for the purpose of constructing and safely maintaining this road; It further appearing to the
Court that the Commissioners' Court should enter on the minutes, an agreement for the reconstruc-
tion of said Upper Turtle Creek Road, and that the donations thereof should be accepted as here-
inabove set out. Therefore, by motion duly made by Guthrie, seconded by Goff, the vote carried
on the absence of Commissioner Powell, that Kerr County Commissioners' Precinct No. 1, be author-
~^ ized to accept the aforementioned donations and that the following agreement be made with said
property owners, to-vrit:
When the grade and base of this reconstructed road is built, using the funds above donated
and any additional money the County itself may have to provide to complete the construction of
