AGREEPI'ENT TO EXTEIv?D F. M. 1273 FROP,4 FETERSON-GRAHAM PROPERTY TO CATTLE GUARD BETWEEN AIIt9E REAL AND J. H. WARE FROPERTY. This the 24th day of September, A. D. 1953, came on to be considered by the Court, the oral agreement between E. A. Graham, J. H. dare, and L. A. Real, and a letter from G. C. Maddox, indi- cating that the following parties desire to donate the aggregate of X8500.00, together with the necessary right of way for the widening and straightening of the upper Turtle Creek Road, which is an extension to F. M. 1273, to commence at the cattle guard between the Joe Sid Peterson and E. A. Graham property and extending in the opposite direction to the cattle guard between the property of Aime Real and J. H. Ware. ',Vherefore the Court is of the opinion that J. F.. YJare and E. A. Graham have agreed orally to give the sum of X1000.00 and $3000.00, respectively; Louis Real, Aime Real and Hugo Real have agreed orally to give the sum of $4,000.00, and G. C. Maddox Imo-- has agreed by letter to give in like manner to Kerr County, the sum oY 500.00. St appearing to the Court that such donated money given to Kerr County should be accepted for the specific pur- pose of repairing the existing Turtle Creek Road between the points hereinabove set out and wherever necessary, in straightening, building new, widening or in any other way improving the upper Turtle Creek Road; in addition to the money hereinabove sat out, the parties agree to furnish to Kerr County, Right of '~Yay Deeds or Easements as they so choose, 40 feet in width through the whole length of the reconstructed Turtle Creek Road, with the exception of the water crossings, which shall be so wide as the Commissioner or Gounty Surveyor shall deem necessary for the purpose of constructing and safely maintaining this road; It further appearing to the Court that the Commissioners' Court should enter on the minutes, an agreement for the reconstruc- tion oY said Upper Turtle Creek Road, and that the donations thereof should be accepted as here- inabove set out. Therefore, by motion duly made by Guthrie, seconded by Goff, the vote carried on the absence of Commissioner Powell, that Kerr County Commissioners' Precinct No. 1, be author- ized to accept the aforementioned donations and that the following agreement be made with said .~ property owners, to-wit: When the grade and base of this reconstructed road is built, using the funds above donated and any additional money the County itself may have to provide to complete the construction of the grade and base, Kerr County will at its own cost and expense in consideration of the above ~ w. 4 f. .~ gift, top said base with a double shot asphalt coat 18 feet in width, according to State High- way specifications; that Kerr County is to immediately commence construction of said fill and base and continue said construction using all due diligence until such roadway shall be com- pleted; that references to Rerr County used herein when applging to receipts and expenditures, ^ shall be debited and credited to Commissioners' R. & B. D. 1953, came on to be considered by the Court the claim of Jim Dale for 200 cedar posts at x.75 each, being in the amount of X150.00. It appearing to the Court that said claim is reasonable and dust and should be allowed. Therefore, by motion duly made by Goff, seconded by Bartel, the vote having carried with Commissioner Powell absent, the County Clerk be, and is hereby directed to draw voucher against the County Treasurer in the amount of One Hundred Fifty and No/100 0150.00) Dollars, payable out of F. M. 689, in favor of Jim Dale for 200 cedar posts at x.75 each. o-e-o-o-o-o-o No. 6286. ORDER AUTHORIZING APPOINTP.''.ENT OF BETTY FURNEY, DEPUTY COUNTY CLERK. This the 24th day of September, A. D. 1953, came on to be considered by the Court, the app- lication of Lawrence Stephens, County Clerk, for his authority to appoint and deputize Betty Burney as Deputy County Clerk, and it appearing to the Court that said officer is entitled to said deputy and that said application should be approved; therefore, by motion duly made by Bartel, seconded by Guthrie, the vote having carried with Commissioner Powell absent, that said officer is authorized to deputize said Betty Burney, and that said appointment date from Septem- ber 24th, A. Wherefore, the Court has heretofore entered into a contract with the State Department of Public Welfare to withhold Social Security on full-time employees on a salary or fee basis, excluding salary on any part- time or on an emergency basis; and whereas, at the request of Newton C.
