Wehmeyer and wife, Frances ~yehmeyer, 'Kerner F. pJehmeyer and wif e, Lois ~.veh- meyer, and Emil G. ~Jehmeyer and wife, Freida Wehmeyer, hereinafter called Parties of the Second part, 'fJITNESSETH: 'WHEREAS, the County of Kerr, State oP Texas, has heretofore purchased from Parties of the Second Part a strip of land 30 feet in width off the extreme South side of Parties of the Second part's property for road purposes, such property having been purchased for the purpose oP widen- ing the existing load now adjacent to said property; and, `NHEREAS, there is now existing on said property trees, shrubbery, fences, together with other improvements, which were not included in such sale; the said Parties of the Second Part ~,~~ ~. shall have the privilege of removing from said premises all improvements situated thereon at any time prior to the first day of April, 1954, and if they, the Parties of the Second Part, have not removed said improvements from said premises by the first day of April, 1954, then the County shall have the privilege of going in and at its own discretion moving all said improve- ments, or in the alternative, they may have them moved by the State of Texas, in either instance, the cost of such removal to be borne by Parties of the Second Part; the County of Kerr or the State of Texas shall not be responsible to Parties of the Second Part for destruction of any oY those improvements remaining on said land as of ,April 1, 1954, or any damage resulting therefrom. YdHEREAS, the County of Kerr, State of Texas, realizing that Parties of the Second Part are suffering damages as a result of the removal and/or destruction of their improvements as a result of the widening of the existing road, County of Kerr, State of Texas, agrees to pay to Parties of the Second Part the sum of X3,000.00 in full, complete, and final settlement of any and all claims arising out of this transaction between Party of the First Part and Parties of the Second Part.
