ment presented by the Sixth Administrative Judicial District, in the amount of X52.00. It
appearing to the Court that the amount of52.00 is fixed by the Judge of the Sixth Administra-
tive Judicial District for the necessary expense of this district as per Section 9, of Article
Sdo. ~OOA, Revised Civil Statutes of the State of Texas, aryl that this amount should be paid to
Emma Stewart, Clerk of the Sixth Administrative Judicial District, Del Rio, Texas. Therefore,
by motion duly made by Bartel, seconded by Goff, and unanimously approved by the Court that the
County Clerk be, and is hereby directed to draw voucher in the amount of X52.00 on the County
Treasurer, payable to Emma Stewart, Clerk of the Sixth Administrative Judicial District out of
the General Fund of Kerr County.

CONTRACT.
This the 10th day of November, A. D. 1953, came on to be considered by the Court, the re-
quest of E. H. Nichols, Tax Assessor and Collector to enter into a maintenance agreement Yor
servicing one I. B. M. Electric Typewriter, model 11520101, serial No. 176708, for a charge of
,30.00 with four inspection trips in the amount of X10.00, with emergency expense to be figured
at the rate of 7y~ per mile. It appearing to the Court that said officer should be authorized to
enter into said maintenance agreement as prayed for. Therefore, by motion duly made by Goff,
seconded by Bartel, and unanimously approved by the Court, that E. H. Nichols, Tax Assessor and
Collector, be and is hereby authorized to execute said I. B. Td. Electric Typewriter contract.

Goff, and unanimously approved by the Court, that Kerr County enter into the following contract,
to-wit:

This memorandum of agreement this day made and entered into by and between Kerr County,
Texas, acting herein by and through its duly authorized Commissioners} Court and County Judge,
sitting in regular session of the Commissioners Court, hereinafter called Party of the First
part, and Elgin T. Wehmeyer and wife, Frances ~yehmeyer, 'Kerner F. pJehmeyer and wif e, Lois ~.veh-
meyer, and Emil G. ~Jehmeyer and wife, Freida Wehmeyer, hereinafter called Parties of the Second
part, 'fJITNESSETH:
'WHEREAS, the County of Kerr, State oP Texas, has heretofore purchased from Parties of the
Second Part a strip of land 30 feet in width off the extreme South side of Parties of the Second
part's property for road purposes, such property having been purchased for the purpose oP widen-
ing the existing load now adjacent to said property; and,
`NHEREAS, there is now existing on said property trees, shrubbery, fences, together with
other improvements, which were not included in such sale; the said Parties of the Second Part

shall have the privilege of removing from said premises all improvements situated thereon at
any time prior to the first day of April, 1954, and if they, the Parties of the Second Part,
have not removed said improvements from said premises by the first day of April, 1954, then the
County shall have the privilege of going in and at its own discretion moving all said improve-
ments, or in the alternative, they may have them moved by the State of Texas, in either instance,
the cost of such removal to be borne by Parties of the Second Part; the County of Kerr or the
State of Texas shall not be responsible to Parties of the Second Part for destruction of any oY
those improvements remaining on said land as of ,April 1, 1954, or any damage resulting therefrom.
YdHEREAS, the County of Kerr, State of Texas, realizing that Parties of the Second Part are
suffering damages as a result of the removal and/or destruction of their improvements as a result
of the widening of the existing road, County of Kerr, State of Texas, agrees to pay to Parties
of the Second Part the sum of X3,000.00 in full, complete, and final settlement of any and all
claims arising out of this transaction between Party of the First Part and Parties of the Second
Part. The X3,000.00 consideration shall be paid as follows: (1) Emil G. ',Yehmeyer and wife,
Frieda ?+dehmeyer X1,157.04; {2) Werner F. ~dehmeyer and wife, Lois Wehmeyer X1,801.90; and (3)
..., Elgin Wehmeyer and wife, Frances Wehmeyer X41.06.
