No. 6394. PETITION OF C. E. GILLIS, ET AL, FOR ABANDONMENT AND ORDER CLOSING ROAD.
On Lhis, the 15th day of December, 1953, came on to be heard the petition oP C. E. Gillis,
et al, to discontinue a portion of the old Hunt-Leakey road which passes across property herein-
after described; and the Court after a full investigation of the proposed change, finds that the
portion of the road requested to be abandoned has in fact been abandoned for some period of years
end that Highway #39 replaces such road and that no portion of the road to be abandoned passes
over end across Highway #39 and that the public interests will be better served by abandoning
by GoPP, by Bartel,
such road, and upon motion duly made/and seconded/and by unanimous consent of all the Commis-
sinners elected it was agreed that such portion oP the old Hunt-Leakey road should be abandoned.
IT IS THEREFORE ORDERED, ADJUDGED AND DECREED that the portion of the old Hunt-Leakey road
passing over and across the land described ea Pollowa:

SAVE AND EXCEPT THEREFROM such rights, grants, privileges, rights of way and easements, pertain-
ing to said 18.15 acres, as were conveyed to C, E. Gillis, by deed dated September 17, 1938,
Prom P. J. Domingues, recorded in Volume 63, Page 395, Deed Records of Kerr County, Texas; AND
LESS HOWEVER, that 1.13 acres oP lend which was excepted Prom that deed from Mrs. Alice Jobes,
a widow, to C. E. Gillis, et ux, dated September 21, 1949, recorded in Volume 86, Page 608,
Deed Records oP Kerr County, Texas; said 1.13 acres being fully described by field notes in
said deed,
be abandoned and discontinued, and that the property owners on each side oP said road shall
own the title to such property within the roadbed abandoned to the center line thereof.

seconded by Bartel, and unanimously approved by the Court, that the petition oP G. P. Cade, et
sl, requesting the Commissioners' Court of Kerr County to accept a right oP way for public pur-
poses, which leads Prom the Ingram-Hunt Road across the Guadalupe River and through part of
Survey 133, A. Reinaman, be rePiled by the petitioners with proper field notes and that the
County Clerk be and is hereby directed to notify said petitioners oP this action.
