It is further ordered, adjudged end decreed by this Court that a Jury of Freeholders, as for other public roads, as required by Article 6711 of the 1925 Revised Civil Statutes and the Amendments thereto, be apcointed by this Honorable Court to assess the damages which accrue to the lar:dov,ners described in this decree, to wit: J. E. Dowdy, G. C. Dowdy, Kyle Dowdy, J. F. Duke and wife, Susie Duke, and that they return to said Court their findings as to the amount of the damages su_fered by said landov+ners, within the time rec_uired b~ law, a°ter hearing evidence as to such damages and after appraising and fixing the amount of said damages, It is further ordered, adjudged and decreed by tY,is Court that Kerr County, Texas, pay for all costs in connection with this proceeding, as well as all of the costs for such damages which may accrue in Pavor of said landowners by reason of the taking of said land and by reason of such other damages as they may be entitled to as a natter of law. D, 1y54, at the regular n_eeting of the Ccmmissicners Court, there came on to be heard the applicatiam of Charles R, Rodgers and wife, Opal Joyce Rodgers for the estaclishment of a public neighborhood road, the application for ;vhich is on file in the County Clerk's office of Kerr County, Texas, snd with the Commissioner's Court cf Kerr County, Texas, same being numbered 6517 on tY~e minutes and Docket of the Corunissior°:erts Court, Kerr Gounty, Texas; and it further appearing to the Court that on the 17th day of Feb- ruary, 1954, the Commissioners Court of Kerr County, Texas, entered an order on the mrinutes of said court and docket of the same appointing a Jury of View tc lay out said road and assess damages therefor; and it now appearing to tiie court that this Court was in error in aplointing said Jury of View at that time, the same being prematurely entered because it now appears that under the terms and rrovisi.ons of Article 6711 of the 1925 Revised Civil Statutes and amendments thereto and particularly the amendment by the 53rd Legislature, that tYiis court does not appoint a Jury o£ View until such time as fire court passes on the apiaication of the applicants Charles R. It appearing to the Court that said claims and accounts filed ag^inst each fund should be paid, and that the payment of the labor bills as per sworn affidavit filed with the County Clerk for the weeks aforesaid, be confirmed as paid.
