TBIS AGREEMENT, made this 15tH day oY July A. D. 1955, by and between Kerr County, Teaas,~
hereinafter called the "County", Party of the First Part, acting by and taro ugh its Commiasion-
ers Court and the State of Texas nereinefter celled the ^State", Party of the Second Pert,
acting by ahd thm ugh its state HSghwey Commisslon.
WHEREAS, the County desires the construction of concrete curb and gutter within the limits
from north city limit of Earrville to Gillespie count9 line on State Highway No. 16, wnian 1s
solely the County's responsibility and the County Has requested the State to oo nstruct or have
constructed this work. The State will construct or have constructed this work for and on be-
Half of the County and at the County`s sole expense. The estimated cost of thin work is Twely
Thousand Six Hundred and No/100 Dollars ($12,600.00), including contingencies and engineering.
NOW THEREFORE, it is understood that this proposed work will be constructed by the State
and the County will transmit to the State with the return of this agreement, executed by the
County, a warrant made payable to the State Treasurer, Account of Trust Fund No. 92'1 in the
amount of Twelve Thousand Six Hundred end Db/100 Dollars ($12,600.00), t5 be used in paying fo
the proposed work requlred by the County. It is Yurtner understood that the State will conetr
only tno ae items for the County as requested and required by the County and the entire cost of
such items will ~he home by the County. IP the State elects to reveive bide and if upon re-
ceipt of bids by tna State and/or the actual construction and/or approved changes in the con-
templated improvements it is found that this amount is insufficient to pay the County's port i5
