THIS AGREEMA7T, made this 10th day of Jan., 1956, by and between Barr County, Texas,
hereinafter called the "County", Party of the First Pert, acting by end through its Commiasic
ers Court and the State of Texas, hereinafter called the "State", Party of the Second Part,
acting by and through its State Highway Commission.
WHEREAS, the County desires the oonstruction of ooncrete curb through the community
of Center point on Fsrm to Market Road No. 480, whioh is solely the County's responsibility
and the County has requested the State to construct or have es nstruct ed this work. The State
will construct or have constructed this worK for and on behalf of the County and at the County'
sole expense. The estimated construction cost of this work is Seven Thousand One Hundred end
No/100 Dollars (l7 ,100.00), including contingencies and construct ion engineering, and
WHEREAS, the County by the execution of this agreement agrees to the terms and oondi-
tions of St ˘te Highway Commission Minute No. 38579, as it applies to the County, a copy of
which is attached hereto and marked "Exhibit A" and made a part of this agreement.
NOW TREREFORB, it is understood that this proposed work will be constructed by the
State ˘nd the County will transmit to the State with the return of this agreement, executed
by the County, a warrant made payable to the State Treasurer, Account of Trust Fund No. 927 in
the amount of Seven Thousand One Hundred and No/100 Dollars (7,100.00), to be used is paying
for the proposed work required by the County. It is further understood that the St ste will
construct only those items for the County es requested and required by the County and the anti
cost of such items will be borne by the County. If the State elects to receive bids and if
upon receipt of bids by the State and/or the aetuel construction and/or approved changes in th
contemplated improvement it is Pound that this amount Ss insufficient to pay the County's pqr-
tion, then the County upon request of the State will forthwith supplement this amount by an
amount equal to the County's Pull astimat ed or actual share of the cost of this work less the
amount previously paid into Trust Fund ~. 927. In the event the amount as paid is more than
the actual cost then the exoess amount will be returned to the County. It is further under-
stood that the work to be done on behalf of the County, as herein provided, will include the
cost of contingencies sod construot ion engineering. I~t is further understood that the County

WHEREAS, in KERR CODNTY on FARM-TO-MpRKEf 480, Barr County has re quested assistance in th
widening of pavement including incidental items thereto through the Community of Center Point,
~ a distance oP approximately 1.2 miles.
NOW, THEREFORE, the State Highway Engineer is directed to tender the following proposal
to the County of Barr:
Provided the County will:
1. Provide all necessary right-of-way clear of obstructions and will provide for the
immediate construction of coot inuoue curb end gutter, utility ad3uatmenta, storm sewers, etc.,
