and the Court having been opened, .the following proceedings were had, to-wit: o-o-o-o-ono-o-o-o-o r N0. 8265 AGREEMENT OF COIINTY TO SHARE IN HUIhDING STOCKPASS ON PROPERTY OF ADOI3R 3TIELER On this the 30th day of April 1959, at a Special Term oY the Commie eioner'e Court of Kerr County, Texas, with a quorum of said Court being present, came to be heard and consider the matter oP constructing a stockpase for the use of Adolph Stieler on the Kerr County sec- tion of U. S. Highway 87; And it appearing to the Court that under the terms and epecificatione of Federal Aid Project 631-D approved April 12, 1932, ouch a stockpaee was provided for, but due to the the existing financial condition oY Kerr County, said atockpase remained unbuilt although it had been included ae a pazt of the consideration due to be granted Adolph Stieler for the donati of all necessary lands for the Right-of-Way aoross..his property for said project; And it further appearing to the Court that the now proposed widening oŁ the Right-oY- Way oP U. 9. Highway 87 from 100 feet to 200 feet to accommodate a Your-lane, divided high way facility plus the greatly accelerated volume and speed of traffic on said highway over and above that anticipated in the year 1932, make the construction of this atockpase Łacilit a necessity to provide the said Adolph Stieler with the measure of compensation to which he became justly entitled by reason of the physical cleavage oŁ hie property, and it Yurther being s necessity to protect traffic on said highway from the hazard of crossing livestock over the said roadway; It is hereby ordered that the Commissioners Court oY Kerr County, Texas, does hereby agree to and obligate said County to participate on a 50 per cent coat sharing basis with the State of Texas in building and providing a standard atockpase (5'x6'6") on the property of Adolph Stieler at Station 1302+73, on the section of U. S. Righway No. 87, being planned for reconstruction betweem the Kendall-Kerr Oounty line and the Kendall-Kerr County line, and it ie hereby requested that the State of Tezae participate in the cost of the conetruot- ion of the above atockpase facility to the extent oY 5096 oY its cost, with the remaining co e to be borne by Kerr County. Schreiner Bank.: of Kerrville, Texas, the sum of $3285.00, being part payment on note executed by Commissioner of Preoinet No. 1 in favor of ea id bank, same to be paid out oP Road & Bridge No. 1 Fund, and leaving a balance of $3285.00 to said Bank.
