surplus ilutde on deposit Sn the 1931 Road Sond Sinking Fund, and after reviewing the statue oY
:he remaining re qu irementa of saki sinking Fvnd, it is the finding oP the Court that total out
standing pr Sncipal and interest re qu iramenta of acid 1931 Road Bond Issue are $15,375.00, all
~f which amount Sa due and payable on February 10, 1961;
And St is the Slxrther rinding of the Court that there has been appropriated by the State
if Texas from available flusdn the sum of $5,593.43 and that there has been withheld from Kerr
:ountyss share of the surplus in the County and Road Diatriot Highway Fund the sum oP $9,781.$7
the said tyro amounts totalling $15,375.00;
And 1t is the Further Sinding oP the Court that there are presently on depoa it with the
Board oP County and Diatriot Road Indebtedness at Austin, Texas, U.S. Government Bonds, Series
"0", in trie face amount of $50,000,00 belonging to Kerr Countyf
It is therefore the finding of the Court that the sum of $21}, 988,1y4 ourrantly on depoa it
to the credit of said sinking fluid in the County Depository is Par in excess of any claims
which copld vest agai net said eink7,ng fluid by operation of lax.
It is there Pore ordered that the Tre aeurer create a new fund to be known as "Specs el Right
of-Way Fund", and that the sum of $24, 9$8,14 be transferred by the County Clerk and County
Treasurer Prom said 1931 Road Hond Sinking Fund account to said Special Right-oP-Way Fund and
that such funds transferred be expended only for purposes incidental to the procurement of
rights-of-way for hlghway s, farm-to-market and/or lateral roads in Kerr County, Texas, auoh
eapenditurea being in accordance with the lawn of the State of Texas and in keeping with the
purposes for which the said 1931 Road Bond Sasue wsa originally authorized.
The foregoing order was duly passed on motion by Commiaeioner Bartel, seconded by Commies
