On this the 12th day of September 1960, 6ama on to be heard and considered the matter of
surplus 1lutda on deposit in the 1931 Road Bond Sinking Fund, and after revlaxing the statue of
the remaining re qu irementa of said sinking Fund, it is the finding oP the Court that total out
standing principal and Sntereat requirements of said 1931 Road Bond Issue are $15,375.00, all
of which amount is due and payable on February 10, 1961;
And it is the further rinding of the Court that there hoe been appropriated by the State
of Texas from available fllnde the sum of $5,593.43 and that there has been withheld from Kerr
County~a share of the surplus in the County and Hoad Dlatrint Highway Fund the sum oP X9,781.57
the Bald two amounts totalling X15,375.00;
And it ie the further finding of the Court that there are presently on deposit with the
Board of County and District Road Indebtedness at Auetln, Texas, U,S. Government Bonds, Series
"G", Sn the face amount of $50,000,00 belonging to Kerr County;
It is therefore the finding of the Court that the sum of $24,988,44 currently on deposit
to the cre dlt of said sinking 1Y~nd Sn the County Depository is far Sn excess of any claims
which copld vest agai net said sinking fluid by operation of law.
It is therefore ordered that the Treasurer create a new fund to be known as "Special Right
of-Way Fund", and that the sum of $24,98,114 be transferred by the County Clerk and County
Treasurer from said 1931 Road Bond Sinking Fund sac cunt to said Spealal Right-of-Way Fund and
that such ilutda transferred be expended only for purposes incidental to the proaurement of
rights-oP-way for highways, farm-to-market and/or lateral roads Sn Kerr County, Texas, such
eapendituree being in ac cordanae with the laws of the State of Taxae and in keeping with the
purposes for which the said 1931 Road Bond issue wsa originally authorized.

D-15-38. by the Tease Highway Department should be entered into; it is hereby Ordered that the
