THE STATE rJF TEXAS } CrJUNTY OF KERB } This agreement made and entered into by and between the CITY QF KERRVILLE, KERB COUNTY, TEXAS, hereinafter called party of the first part, acting pursuant to the resolution hereto attached, through its Mayor and attested by its City Clark. and KERB COUNTY, TEXAS, hereinafter called party of the second part, acting through the Commissioners Court of such County, pursuant to the order of the said Commissioners Court. a copy of which is hereto attached; VdITNESSETH: The Party of the First Part agrees to furnish for the use and benefit of citi$ans of Kerr County, Texas, outside of the city limits of the City of Kerrville, Texas, its fire trucks and other fire fighting equipment, together with personnel to rnatntain and operate the same for a period of one year, beginning on the 1st day of June, 1960, and terminating on the 3lst day of May, 1961. under the following terms and conditions, to-wit: A. The Party of the First Part through its employees, will go to and assist in proper fire prevention, firs fighting and fire safety anywhere within Ken County, Texas, during the period of this contract, when called to do ao. In this connection, it is understood that the report of any fire outside the city limits of the City of Kerrville, Texas, shall b® sufficient notice for the Party of the Fira4 Part, through its employees, to go to the location of said fire, with its fire trucks and fire equipment for fire fighting, fire prevention and fire safety, and further it !a understood and agreed between the parties berate that this contract and agreement is under the conditions and terms of Art. 2351a-1 of the Revised Civil Statutes of the State of Texas. Theca provisions shall, however, ba subject to such modifications as may result from Part B hereof. B. The Party of the First Part shall, at the end of ench calendar month, furnish the Party of the Second Part with a list of all calla answered by the fire fighting equipment of the Party of the First Part tcs points in Karr County outside of the corporate limits of the City of Kerrville, Texas. As compensation for fire protection services rendered by the Party of the First Part, the Party of the Second Part agrees to pay to the Party of the First Part the sum of 5150.pQ for each such call answered, unless Party of the Second Part ease fit to request the negotiation of a payment of a leases sum on an individual call answered due to special circumstances, and in suoh event the amount to be paid shall he subject to negotiation by the City Manager and the County Judge. It is further agreed that in the event Party of the First Part answers a fire call within the geographical limits -2- of the jointly owned City-County airport, the Party of the Second Part shall only pay the Party of the First Part fifty percent of the amount of 3150.00 per call, namely, 375,00, payment to be made within 34 days of the receipt of such above described list of calls . G . The parties further agree that this contract can be renewed from year to year by Party of the Second Part agreefnq and paying to the Party of the First Fart the sums of money as given in Paragraph B, this being done by order of the Commissioners Court of Ken County, Texas, renewing said contract and delivering to the Party of the First Part within twenty (20) days prior to the expiration of the contract year for letter acceptance by the Party of the First Fart . 97. The County of Kerr egress to indemnify and hold harmless the City of Kerrville for any damages or injuries to employees , agents , workman, or firemen of the City of Kerrville or to any person or pezsons property as a result of answering or performing fire calls outside the City of Kerrvlle. Should any parson asserting claim, causes of action, or file suit for damages to his person, or his property, than the County of Kerr agrees to defend all such claims, causes of action, or suits, provided, however, that by this agreement the County does net waive but specifically reserves every common law defenses which it might otherwise plead with respect to any person injured in his person or property or both as above set out. E. I t is understood and agreed that, should the City of Kerrvilie's Fire Insurance Rate be }eopardiaed in any manner, as a result of answering fire calls outside the city limits, then the City of Kerrville shall have the right to terminate this agreement upon immediate notice either written or oral to the County of Kerr.
