426 . 8855 ORDER FIKING METHOD OF COMPENSbTION FOR UTILITY ADJUSTMENT OF HILL COUNTRY TELEPHONB COOP ALONG HIGHWAY ~l RIGHT-OF-WAY On this the 8th day of May 1961, came on to be heard and considered by the Court the matte ..~ utility adjustment prone dare and compensation agreeme nta with the Hill Country Telephone op. along State Highway 41, and it appearing to the Court that it would be to the advantage Kerr County to have the Coop proceed immediately to move its lines as required from the new ght-of-Way for Highway 41, it is Ordered on motion by Commissioner Stone, seconded by Com- esioner Bartel and unanimously approved by the Court that the Hill Country Telephone Coop. authorized to commence immediately to move its lines from the new Right-of-Way for State ghway No. 41, and that upon completion, Kerr County will pay the Coop. for its actual costs tarred and thereafter submit a billing for reimbursement of fifty percent of such costa to e Texas Highway Department as per the authorisation of said department granted by letter, tad May 3> 1961; and it is further Ordered that this agreement shall be eub~e ct to the agree- nt of the Hill Country Telephone Coop. to reimburse Ktlrr County is full for any coats paid ich are subsequently disallowed by the Texas Highway Department as being ineligible for fifty sharing. o-o-o-o.o-o-o-o 8856 ORDER ESTABLISHING PROCEDGRE FOR PARTIAL PAYMENT TO FENCING WNTRACTGRS FOR STATE HIGHWAY 41 RIGHT-OF-WAY On this the $th day of May 1961, came on to be heard the matter of establishing procedure or partial payment to fencing contractors presently constructing fences for State Highway 41 fight-of-Way, and it appearing to the Court that Kerr County has agreed by the general terms f its fencing contra cta to make partial payments to ba limited to the equivalent percentage f work actively completed on individual contracts, leas fifteen percent, and it appearing to he Court that the contractors require frequent partial payments to meet payroll and equipment xpensea and that such pe rtial payments are necessary, in order to expedite prompt completion f existing contracts, it is therefore Ordered on motion by Commissioner Bartel, seconded by ommiasi on er Schwethelm and approved by the Court that the Clerk and the Treasurer be author- zed to draw vouchers on Nighway 41 No. 2 Fund for such partial payments to individual contract rs upon presentation of a written statement approving such payment a, approval to be evidenced y the ,joint signatures of the Commissioner of Precinct No. 4 and the County Judge; provided , that final payments shall be made only after acceptance of work performed by the Com- ~ Court and on the specific Order of said Court. o-o-o-o-o-o-o-o . 8857 AMENDING ORDER 8786 GRANTING ALLOWANCE TO MRS.
