On motion made by Commissioner Schwethelm and duly. secondsd by Judgs Neunhoffer, the f oxing Order was adopted by a maJ orlty vote, with Commisai mere Schwethelm, Bartel and Judge Neunhoffar voting Aye, and Commissio Hera Stone and Powell voting No. Thnt the Kerrville Indians Baseball Club of Kerrville, Tsxae, be authmrized to use app imately four acres oP land oompr icing the eo uthermost portion of that part of the Agricultural Exibit ion Building grounds lying between State Highway Z/ and the Old San Antonio Highxay, said use to ba for amusement and recreational purposes only and aubJect to the following terms and Condit lone: 1, The Club shall be permitted to construct a baseball diamond together with seating facilities and other necessary appurtenances on the premises. 2. During such time ae the area ie actually in use by the Club, the Club shall have authority to control entrance by the public, into the portion of the Agriaultural Exhibition Building grounds lying between State Highway 27 and the Old San Antonio Highxay and East of the present roadway paralleling the lines of the Kerrville Telephone Compsay. This control ', shall be effected by Lhe Clubs erect ion of a suitable barr Ser to vehiaular traffic on a line parallel to the road crossing the grounds, and such distance from the road ns the Commiasioneri Court may direct. Entrance into the area under control of the Club shall ba by a sew entrance established through the existing Pence line on the North aide of the Old San Antonio Highxay, 3. Vehicular traffic within the area of aont rolled entrance shall be kept to a min Smum and confined to roadways and parking erase which the Club shall establish and mark. 4. Nothing in this Order shall be construed as authorizing the erection of fences design ed to constitute visual battlers to spectators and it is expressly understood that spectator control shell be effected by control of persons entering the area through the one authorized entrance on Lhe Old San Antonio Highxay, 5. Kerr County reserves She right to terminate the authority of usage herein granted by order of Ste Commissioners Court at any time xith or without specific cause and the Commisaior ere Court shall in no way incur arty liability for the exero isa of Sts discretion in this matte Upon an order of termination, the Club shall have 30 days to remove any and all improvements made on the premie ea and restore the premises to their original condition. 6. The Club may at its option surrender the premises to Kerr County and may remove any Sm- provementa made thereon. 7. The right of removal or improvements herein granted in Section 5 and 6 hereof 1e con- e ditloaed upon the restoration of the pramisea to their original condition by the Club. 8.
