N0. 9090 ORDER FIXING COMPENSATION TO BE PAID WILLIAM BURNEY ET AL FOR RIGHT-OF-WAY FOR

On this the 26th day of January, 1962 Dame on to be heard and oonsidered by the Court the
matter of compensation to be paid William Burney st al for oonveyanoa of 5.935 acres of land
out of Survey 63 and 64 in Kerr County, required for right of way for F.M. Road 689p and it
appearing to the Court that the various owns re of the said land have agreed to accept the sum
oP $890.25 as compensation Por land and damages, together with oonatruotion of a new Pence,
it Sa Ordered on motion by Oo:mniasioner Schwethelm, eeaonded by. Commisaio ner Powell and unani~
mouely approved by the Court that Karr County pay the sum oP g890, 25 for the aforesaid 5.935
acres of right oP xay and that Knrr County will construct a new standard type livestook fonoe
from a point approximately opposite Station 253 to a point approximately opposite Station 299+ ^
40,3 of the centerline of the proposed route of F.M. Road 689, and it Se further Ordered that
the Clerk and the Treasurer be authorized to draw txo vo uchere totaling $890.25, on the F.M.
689 right of way 11~nd as follows:
1. Voucher in the amount of $655.15 representing an undivided 73.592 peraent interest 1~
the said land payable to Ruth Burney Spivey, Bettie Burney Moaty and Mabel Burney Raneleben
sa per agreement of the parties) upon delivery of right oP way deed properly executed by Ruth
Burney Spivey and husband A.E. Spivey, Bettie Burney Moaty and husband Karl Moaty, Mabel Bur-
ney Ranele ben and husband Eddie F. Raneleben, and William Burney and wife Ella Burney.
2. Vouoher in the amount of $235.10 representing an undivided 26.408 peraent interest
in the said land payable to "The Trust Estate Created by the Will of I. H. Burney, Deceased",
said vouoher to be presently delivered to Henry P. Burney, attorney-at-law, to be held by him
for negotiation upon exeout ion of proper Right of Way IJa ed by the Trustees and Independent
executors of the Estate of I. R. Burney, Deceased,

Kerr County pay Herbert J. Jones the sum of $20.70 Tor 0,138 sates of land out oP Survey 63
and 0.046 acres of land for ohannel easements out of Survey 63. and that Kerr County will con-
struct a nex standard type livestock fence along the nev right of way line and clear a strip
of land approximately 10 feet in width inside the nex propertly line oP tree a, so sa to replac
a simil iarly oleared atr ip now exist ing along the press nt right of way line, and St Se further
Ordered that the Clerk and the Tre aaurer be authorized to drax a vouoher on the FM 689 Right _
of Way Fund In the amount of $20.70, payable to Herbert J. Jones, upon delivery of the properl
