On this the Z6th day of Jenuary, 1962 name on to be heard and considered by the Court the
matter of compensation to be paid William Burney st al for oonveyanos of 5,935 scree of land
out of Survey 63 and 64 in Kerr County, regv lred for right of way for F.M. Road 6897 and it
appearing to the Court Lhat the various owns re oT the said land have agreed to accept the sum
of $890.25 ae compensation for land and damage a, together xith oonatruation of a new fence,
Lt is Ordered on motion by Commiealoner Schwethelm, seconded by. COmmiealo ner Powell and unani-
mously approved by the Court that Kerr County pay the sum of $890,25 for the aforeanld 5,935
acres of right of way and that Knrr County will aonatruat a new standard type live stook fence
from a point approximately opposite Station 253 to a point approximately opposite Station 299+ ^
40,3 of the centerline of the proposed route of F.M. Road 689, and St fie further Ordered that
the Clerk and the Tre aeurer be authorized to draw two vouchers totaling $890.25, on the F.M.
689 right of xay fund as follows:
1, Voucher in the amount of $655.15 representing an undivided 73.592 percent interest in
the said land payable to Ruth Burney Spivey, Batt fie Burney Monty and Mabel Hurney Ranele ben
sa per agreement of the parties) upon delivery of right of way deed properly executed by Ruth
Burney Spivey and husband A.E. Sp Ivey, Bettie Burney Mosty and husband Karl Monty, Mabel Bur-
ney Ranele ben and husband Eddie F. Ranaleben, and William Burney and wife Ella Burney.
2. Voucher In the amount of $235.10 repreae nt ing an undivided 26.408 prase nt interest
in the said land payable to "The Trust Estate Created by the Will of I. H. Burney, Deceased",
said voucher to be presently delivered to Henry Y. Burney, attorney-at-law, to be held by him
for negotiation upon exeaut ion of proper Right oP Way IB ed by the Trustees and Independent

matter of Taxing ooagieneat ion to be paid Herbert d. Jones for right of way and ohannel Basemen
for FM Road No, 689, and it appearing to the Court that the sum of X20.70 plus ereotion of e
new fence would be reasonable compensation for such right of way and channel easement, it fie
therefore Ordered on motion by Cortmii eaioner Sohwethelm, Bacon ded by Commissioner Bartel that
Kerr County pay Harbert J. Jones the sum of $20.70 for 0.138 scree of land out of Survey 69
and 0.046 acres of land for channel easements out of Survey 63, and that Karr County will con-
etruat a nav standard type liveat ock Pence along the nex right of way line and clear a strip
of land approximately 10 feet in width Saeide the nev propertly line of trees, eo as to replac
