After giving due conaiderat ion to the testimony heard by the Court this dots and the lnx

data, it ie Ordered on motion by Commissioner Stone and seconded by Commissioner Bartel that
the Petition of G. F. Hoffpaulr and wife to open a neighborhood road ecresa the lands of L. C.
Getz under the terms of Article 6711 Y.A.C.T., be denied due to the failure of the petitioners
to show that a public neceea ity would be serve d.by the opening of such a road and due to the
Purther failure of petitioners to show that their pet It ion does not Pall under the rule of law
ae announced by the Supreme Court oP Texas in the case of Maher ve Lasater, 354 3W 2nd 923.
On the foregoing motion Commissioners Stone. and Bartel voted AYE, and Commissioner Schwstk
elm abstained, whereupon the motion Mae declared to have oarried by s majority vote.

On this the 26th day of November, 1962 came on to be examined by the Court the claim of
Tom Ranedell Gravel Co., for topping rock in the amount of X312.50, payable out of Road k Brl
Fund; also claim of L. G. Lackey for closing Channel Eaeements.etc~, is th9 aua of $850.00,
payable,out of, Hivy 41 #2 Fund. On motion by Commissioner Sahwethelm, seconded by Commissions
Stone, the Court unanimously approved that the County Clerk and Treasurer be authorized to
issue vouc here in payment oP said amounts.
