Gertz under the terms of Article 6711 V.A.C.T., be denied due to the failure of the petitioners
to show that a public naceeaity xould be serve d.by the opening of ouch a road and due to the
further failure oP petitioners to ehox that their petition does not fall under the rule of lax
ere announced by the Supreme Court of Texas in the case of Maher ve Lasater, 3$4 SW 2nd 923.
Oa the foregoing motion Commieaioners Stone and Bartel voted AYE, and Commissioner Schwstt
elm abatalned, whereupon the motion was declared to have oarried by a majority vote.
