On this the 11th day of i~iarch, 1963, came on to be heard and considered by the Court the
matter of disposition of two sections of old right-of-way of State H;ghway TJo. 41 situated
in Kerr County and it appearing to the Court that the designation of the two following sections
of Right-of-[day as a portion of the State Highway System has been cancelled by the terms of
Texas Highway Commission i~:inute Order <do• 52189 passed January 14, 1963, namely:
1. Fro r;. a function of old and new locations of State Highway 41 at Station 645 02 on new
location eastward to another junction of the old and rew location of tl-ie iiigl:way at Station
671 f 42 on the new location, a total distance of approximately C.SG mile.
2. From a function of the ol.d and new locations of State highway 41 at Station 796 ~ 02
on new location eastward to another junction of old and new :Location of the highway at Station
811 f 96 on the new location, a total of approximately 0.31 mile.
(The t~.ao foregoing Sections being described more particularly b;j metes and bounds as set forth
in Appendix "A" of this order).
And it further appearing to the Court that the land comprising these two sections of old
right-of-way is no longer needed for the use of citizens as a road and that title to the said
two sections of old right-of-way was originally acquired in the name of Kerr County for use
by the State of Texas, it is therefore ordered on motion by Commissioner Stone, seconded by
Ccmmissioner Bartel and unani,:.ously approved by the Court that on the basis of the facts
hereinabove set forth, the Texas Highway Department and the State of Texas be requested to
convey b;rr quitclaim deed or otherwise to Kerr County, Texas, all of the right, title and
interest of the State in the above referred to taro sections of old Right-of-way of State
Highway Pto. 41 situated in Kerr County which sections are more particularly described by metes
and bounds in Appendix "A" of tllis order, and it is further ordered that the Clerk of t:~is
Court furnish the Texas Eighway Department orith a certified cosy of this order, and of
Appenadzx "A" hereto.
