On this the 11th day of i~iarch, 1963, came on to be heard and considered by the Court the
matter of disposition of two sections of old right-of-way of State Eighway No. 41 situated
in Kerr County and it appearing to the Court that the designation of the two follotaing sections
of Ri.~ht-of-?Jay as a portion of the State Highway System has been cancelled by the terms of
Texas Highway Commission Minute Order No. 52189 passed January 14, 19b3, namely:
1. Faro m a .iunction of old and new locations of State Highway 41 at Station b45~ 02 on new
location eastward to another junction of the old and new location of the highway at Station
671 f 42 on the new location, a total distance of approximately G.SG mile.
2. From a iunction of the old and new locations of State highway 41 at Station 796 ~ 02
on new locatio^ eastward to another junction of old and new location of the higho:ay at Station
811 >< 96 on the new location, a total of approximately 0.31 mile.
(The t~do foregoing Sections being described more particularly by r..etes and bounds as set forth
in Appendix F°A" of ta9_s order) .
And it further appearing to the Court that the land comprising these two sections of old
right-of-way is no longer needed for the use of citizens as a road and that title to the said
two sections of old right-of-way was originally acquired in the nar.!e of Kerr County for use
by the State of Texas, it is therefore ordered on motion by Commissioner Stone, seconded by
Commissioner Bartel and unani~..ously arproved by the Court that on the basis of the facts
hereinabove set forth, the Texas Eighway Department and the State of Texas be requested to
convey by quitclaim deed or otherwise to Kerr County, Texas, all of the rigi~t, title and
interest of the State in the above referred to t~;ao sections o° old Right-of-way of State
highway P1o. 41 situated in Kerr County which sections are more partic~.zlarly described by metes
and 'pounds in Appendix "B," of this order, and it is further crdered that the Clerk of tnis
Court fur:~ish the Texas Iiigiiway Department with a certified cosy of this order, and of
Appe.~d'ix "A" hereto.
