Moore Lumber Yard for fencing material for F/M 2771 R/W as being the lowest and best bid. o-o-o-o-o-o-o-o-o-o NO. 9432 ORDER CANVASSING RETURNS AND DECLARING RESULT OF ELECTION STATE OF TEXAS ~ KERF~ COLT NTY COf~;MON SCHOOL COUNTY OF KERR ~ LISTRICT N0. 2 (INGRANi) ON THIS the 13th day of May, 1963, the County Commissioners' Court of Kerr County, Texas, convened in regular session at the regular meeting place thereof in the Courthouse at Kerrville, Texas, with the following members present, to-wit: JULIUS R. NEUNHOFFER, W. C. SCHWETHELM PRENTICE WTTT ADOLPH BARTEL ROGER °TGNE COUNTY JUDGE, Presiding; and COP91~iISSIONER, Precinct No. 1; COMt~1ISSZONER, Precinct No. 2; COMi~ISSIONER, Precinct No. 3; CONi~;ISSICNER, Precinct No. 4; and among other proceedings had by said Commissioners' Court were the following: There came on to be considered the returns of an election held in said District on the 11th day of May, 1963, to determine whether the Commissioners' Court of Kerr County, Texas, shall have the power to issue bonds of said District in the amount of $43,000 to become due and payable serially, for school building purposes, to-wit: the purchase, construction, repair or equipment of public free school buildings and the purchase of necessary sites therefor, within the limits of said District, and whether there shall be annually levied and collected on all taxable property in said District, a tax sufficient to pay the current interest on said bonds and to pay the principal thereof as the same becomes due, pursuant to the authority of ~B Article 2784e-1, V.A.T.C.S., as amended; and WHEREAS, upon consideration of the returns of said election it appears that the same was in all respects legally held, after due notice had been given and that said returns were duly and legally made; and WHEREAS, it appears from said returns that in respect of the proposition to issue bonds of said District there were cast at said election 268 votes, of which number 141 votes were cast "FOR THE ISSUANCE OF BONDS AND THE LEVYING OF THE TAX IN PAYMiENT THEREOF"; and 127 votes were cast "AGAINST THE ISSUANCE OF BUNDS AND THE LEVYING OF THE TAX IN PAYMENT THEREOF"; therefore IT IS FOUND AND DECLARED, AND SO ORDERED, BY THE COMI~;ISSIONERS' COURT OF KERN COUNTY, TEXAS: SECTION 1: That the aforesaid election was duly and legally called and notice thereof given in accordance with the laws of the State of Texas and the order calling said election; that said election was held in strict conformity with the Constitution and laws of the State of Texas, and the returns thereof have been properly made to the officials of the District entitled to receive same; and that only resident qualified property taxpaying electors of the District, who own property therein subject to taxation, and who have duly rencered the same for taxation were permitted to vote at said election; and, further, that said election properly represents the desires of those qualified to vote as aforesaid. SECTION 2: That a majority of the resident qualified property taxpaying electors of the District, voting at said election, voted in favor of the issuance of $43,000 School Building Bonds and the levying of a tax on all taxable property in said District sufficient to pay the current interest on said bonds and to pay the principal as the same becomes due, pursuant to authority of Article 2784e-1, V.A.T.C.S., as amended; and, therefore, this Commis~icners' Court is authorized to issue said bonds and to levy, assess and collect said tax. The above order having been read in full, it was moved by Commissioner Stone and seconded by Commissioner Witt that the same be passed. Thereupon, the question being called for the following members of the Court voted "AYE": Commissioner Schwethelm, v~itt, Bartel and Stone; and none voted "NO". The County Judge declared the motion carried and the order passed, and the Clerk was instructed to record the same in the proper Minutes of the Courts.
