by the State Highway Commission on June 28, 1963, for the improvement by the Texas Highway
Department of the roads described below and that Kes~r County Agrees to furnish al 1 required
right-of-way free of cost to the State:
From end of proposed R,M, Road at Bandera County Line North to State Highway 39, a distance
of approximately 4.4 miles

On this the 8th day of July 1963 came on to be heard and considered by the Court the

matter of returning to the abutting landowners certain portions of abandoned right-of-way
of State Highway No. 41, and it appearing to the Court that such lands as are described in
that certain C~uitclaim Deed from the State of Texas to Kerr County dated June 17, 1963 and
recorded in Vol, 115, Fage 430, Kerr County Deed Records are no longer required for use as a
rublic roadway and were originally acquired at no cost to Kerr County and therefore should be
returned to the abutting landowners as agreed at the time of right-oŁ-way procurement for
existing State Highway No, 41, it is ordered on motion by Commissioner Stone, seconded by
Commissioner Bartel and unanimously ~ proved by the Court that such portions of abandoned right-
of-way as are described in the aforesaid deed be declared closed and abandoned as a public
roadway and that the County Judge be authorized to e:Kecute the following quitclaim Deeds in

land values and in setting compensation to be paid individual property owners for necessary
Right-of-Way for F, M. Road 2771, and it appearing to the Court that the County Judge seeks to
disqualify himself from participating in these matters due to his being related within the
third degree to s number of the landowners involved, it is orderod on motion by Commissioner
Stone, seconded by Commissioner Bartel and approved by a unanimous vote of the County Commis-
sinners, with the County Judge not participating herein, that the County Judge be excused from
participation in decisions of the Court in the matter of establishing basic land values to be
employed in right-of-way procurement for F,M. Road 2771 and that he further be excused from
participation in the matter of fixing compensation to be paid individual property owners,
except when his participation is requested by the County Commissioners in such instances
where he is not related within the third degree to the owners of the individual properties
under consideration.

N0, 9478 ORDER AUTHORIZING APPOINTNCr:NT OF MARJORY J. NICHOLS AS FULL TIME DEPUTY CLERK
This the 8th day of July, 1963, came on to be considered by the Court the application of
Emmie M, Muenker, County Clerk, for authority to appoint and deputize Marjory J, Nichols as
Deputy County Clerk, and it appearing to the Gourt that said officer is entitled to said deputy
and that the application should be approved; therefore on motion by Commissioner Stone, second-
ad by Commissioner Schwethelm, the Court unanimously approved that said officer be authorized
to deputize Marjory J. Nichols as full time employee, at a salary of ~p2400.00 per annum,
effective August 1, 1963.
