of Arthur Real, Deceased, the Clerk and the Treasurer be authorized to draw a voucher on the
'^ F, M, 2771 Right-of-;,iay Fund in the amount of X869.30 payable to the Trust Fund of the Clark
of the County Court of Kerr County, where said funds shall be held in trust for the benefit
of the heirs of the Estates of Arthur and Fanny Real, Deceased; and upon the determination as
to the method of distribution of the said funds among the said heirs, the Commissioners Court
of Kerr County shall then direct the Clerl: of the County Court to pay the said funds to such
person or persons as shall have been designated to the said Commissioners Court; and
It is further ordered that such portions of oxisting county roadway as may abut or pass
through the lands of the estates shal 1, upon completion of F, M, Road 2771, be considered
abandoned and shall revert to the Estates or their record successors in title in the same
proportion and in the same manner as the abutting lands are hel d; and
It is flarther agreed that in accepting the right-of-way and channel easements herein
described, the Commissioners Court of Kerr County covenants on behalf of itself and its
successors in office to render harmless the Independent Executors of each of the two estates
„~ from any personal liability that may be adjudged against eithor or all of them by a court of
competent jurisdiction as a direct consequence of their having executed the right-of-way
and/or channel easements herein described,

On this the 26th day of duly, 1963, came on to be heard and considered by the Court the
matter oŁ consideration to be offered Victor Real for conveyance of right-of-way and one
channel easement required for F. M. Road 2771; and after due consideration, it is ordered
on motion by Commissioner Schwethelm seconded by Commissicner Tditt, and unanimously approved
by the Court that Kerr County hereby offers Victor Real as consideration for his conveyance
of 2,224 acres of right-of-way out of Surveys 393 J. Hinch, 64 Wm, Watt, 63 W, T, Crook and
392 G, W, Braze al, together with one channel easement comprising 0,073 acres out of Survey
392, Kerr County will execute a Quit Claim Daed to Victor Real to a portion of that certain
(~.'+ acre tract of land out of Surveys 64, 63 and 392 described in that certain conveyance from
Harry Karger, et ux to H. M. Naylor as is of record in Vol. 97, Fage 338, Kerr County Deed
Records, and subsequently conveyed by the said H. M. Naylor to Kerr County, Texas, by Quit
Claim Deed dated March 22, 1963 and recorded in the Deed Records of Kerr County, Texas, said
portions of the said 4,9 acre tract which is to be conveyed boing all of the said tract less
and except the following:
I, 2,019 acres described in certain right-of-way conveyances from Kerr County to tine
State of Texas
II, A small triangle of land comprising about 0.25 acres of land lying to the east of a
northerly extension of the present fence north of Turtle Creek between Victor Real and Andrew
J, Paris, which triangle is bounded on the north by the F, M. 2771 right-of-way line and on
the south by the north line of the present Andrew J, Paris property in the middle of the
existing county road,
And it is further expressly understood that the 2,65 acres, more or less, remaining to
~.., be quitclaimed to the said Victor Real shall be so conveye3 subject to a 0,042 acre channel
easement out of Survey 392 granted by Kerr County to the State of Texas; and
It is further ordered that upon completion of the construction of F, M. Road 2771,
such portions oŁ the existing county road as are ccntained in the area quitclaimed and as may
abut the other lands of Victor Real shall be considered abandoned and shall revert to the said

Victor Real; and that as further consideration, Kerr County will construct a standard live-
stock fence along the new Right-of-Way line of F, M. Road 2771 and furnish two 12 foot steel
gates for installation therein, and the County Judge of Kerr County is authorized to execute
the necessary quit claim deed as herein authorized, upon delivery cf the right-of-way conveyance
and channel easement herein referred to,

No 9493 OFFER TO META REAL ALDERICE FOR RIGHT-OF-idAY FOR F, M, ROAD 2771
On this the 26th day of July, 1963, came on to be heard and considered by the Court
the matter of compensation to be offered Meta Real Alderice for conveyance of right-of-way and
one channel easement required for F, M, Road 2771; and after due consideration, it is ordered
on motion by Commissioner Stone, seconded by Commissioner Schwethelm and unanimously approved
by the Court that Kerr County hereby offers to pay Meta Real Alderice the sum of x,295.80 for
land and damages upon conveyance of 4.080 acres of right-of-way out of Survey No. 394, Thomas
Jackson, together with one channel easement comprising 0,403 acres out of Survey 394; and,
It is further ordered that in addition to the above cash consideration Kerr County will
construct a new fence along the entire new right-of-way line, said fence to consist of heart
cedar posts set 25 feet apart with 3 heart cedar stays between each post and 832-12-12 1~2 net
wire with 3 barbs on top and further Kerr County, will provide 2 new 12 foot steel gates and
Kerr County will relocate the existing wire gap field entrance upon request after construction
of the new roadway; and,
It is further ordered that the Clerk and the Treasurer be authorized to draw a voucher
in the amount of ~w295.80 on F, M, 2771 Right-oŁ-6Jay Fund payable to Meta Real Alderice upon
delivery of the executed right-of-way easement and channel easement,

On this the 26th day of July, 1963, came on to be heard and considered by the Court the
matter of compensation to be offered Eddie Schmidt and wife, Ella Schmidt, for conveyance of
right-of-way and one channel easement required for F, M. Road, 2771; and after due consideration,
it is ordered on motion by Commissioner Witt, seconded by Commissioner Stone and unanimously
approved by the Court that Kerr County hereby offers to pay Eddie Schmidt (the said Eddie
Schmidt being the one and the same person sometimes known as Edward Schmidt, Jr,) and wife,
Ella Schmidt, the sum of $110,40 for land and damages upon his conveyance of 1,747 acres of
right-of-way o>>t of Survey 399, John Bloom, together with one channel easement comprising
0,115 acres out of Survey 399; and
It is further ordered that in addition to the above cash consideration, Kerr County will
construct a new fence along the entire new right-of-way line, said fence to consist of heart
cedar posts set 25 feet apart with 3 heart cedar stays between each post and 832-12-12 1~2 net
wire with 3 barbs on top; and further Kerr County will relocate the existing entrance gate
upon request after construction of the new roadway; and,
It is further ordered that the Clerk and the Treasurer be authorized to draw a voucher
in the amount of X110,40 on F,M. 2771 Right-of-Way Fund payable to Eddie Schmidt and Ella
Schmidt upon delivery of the executed right-of-way easement and channel easement.
