On this the 26th day of July, 1963, came on to be heard and considered by the Court
the matter of compensation to be offered Meta Real Alderice for conveyance of right-of-way and
one channel easement required for F, M, Road 2771; and after due consideration, it is ordered
on motion by Co-imissioner Stone, seconded by Commissioner Schwethelm and unanimously approved
by the Court that Kerr Cour_ty hereby offers to pay Meta Real Alderice the sum of X295.80 for
land and damages upon conveyance of 4.080 acres of right-of-way out of Survey No. 394, Thomas
Jackson, together with one channel easement comprising 0,403 acres out of Survey 391}; and,
It is further ordered that in addition to the above cash consideration Kerr County will ,„,
ccnstruct a new fence along the entire new right-of-way line, said fence to consist of heart
cedar posts set 25 fast apart with 3 heart cedar stays between each post and 832-12-12 1/2 net
wire with 3 barba on top and further Kerr County, will provide 2 new 12 foot steel gates and
Kerr County will relocate the existing wire gap field entrance upon request after construction
of the new roadway; and,
It is further ordered that the Clerk and the Treasurer be authorized to draw a voucher
in the amount of ~w?95.80 on F,M, 2771 Right-of-Way Fund payable to Meta Real Alderice upon
delivery of the executed right-of-way easement and channel easement,

On this the 26th day of July, 1963, came on to be heard and considered by the Court the
matter of compensation to be offered Eddie Schmidt and wife, Ella Schmidt, for conveyance of
right-of-way and one channel easement required for F. M. Road 2771; and after due consideration,
it is ordered on motion by Commissioner Witt, seconded by Commissioner Stone and unanimously
approved by the Court that Kerr County hereby offers to pay Eddie Schmidt (the said Eddie
Schmidt being the one and the same person sometimes known as Edward Schmidt, Jr,) and wife,
Ella Schmidt, the sum of X110.40 for land and damages upon his conveyance of 1,747 acres of
right-of-way ont of Survey 399, John Bloom, together with one channel easement comprising
0.115 acres out of Survey 399; and
It is further ordered that in addition to the above cash consideration, Kerr County will
construct a new fence along the entire new right-of-way line, said fence to consist of heart
cedar posts set 25 feet apart with 3 heart cedar stays between each post and 832-12-12 1/2 net
wire with 3 barbs on top; and further Kerr County will relocate the existing entrance gate
upon request after construction of the new roadway; and,
It is further ordered that the Clerk and the Treasurer be authorized to draw a voucher
in the amount of X110.40 on F,M. 2771 Right-of-Way Fund payable to Eddie Schmidt and Ella
Schmidt upon delivery of the executed right-of-way easement and channel easement. ^

On this the 26th day of July, 1963, came on to be heard and considered by the Court the

matter oŁ compensation to be offered Felix R. Real and wife, Esther R, Real and Felix R, Real,
^" Jr., and wife, Lillian Stieler Real, (the aforementioned four parties being hereinafter referr-
ed to as "owners") for conveyance of right-of-way and three channel easements required for F.
M, Road 2771; and after due consideration, it is ordered on motion by Commissioner Stone
seconded by Commissioner Witt and unanimously approved by the Court that Kerr County hereby
offers to pay the above named owners the sum of X890,70 for the granting of a right-of-way
easement for 14.685 acres of land out of Surveys No, 1135 L. A, Patillo, 400 J. S. Lester,
399 John Bloom, 404 Joseph Purcell, and 398 A, Cameron and three channel easements comprising
approximately 0.351 acres out of Surveys 1135, 400, and 404, and it is further ordered that in
addition to the above cash consideration, the following provisions will ba made for fencing
the new right-of-way line:
In lieu of Kerr County proceeding to build the necessary right-of-way fencing, owners
will build their own fences using such wire as they may desire and two 12 foot steel gates
from Kerr County's material stock piles and Kerr County will, after completion of the fencing,
compensate owners for the reasonable value of the equivalent materials which Kerr County would

have supplied, had the fencing been constructed by Kerr County according to the standards as
employed in providing fencing for land owners on the opposite side of the right-of-way.
Re-imbursement for labor employed by owners in building their fences shall be on the same
basis as Kerr County~s contract price for fence construction on the opposite side of the right-
of-way. Kerr County will provide a bulldozer to clear proposed fence lines for owners herein,
and in addition, it is ordered that on completion of construction of F. M, Road 2771, such
portion of abutting county roadways as shall no longer be required for public use or access
to abutting lands, shall be considered abandoned and shall revert to the holders of record
title thereto, and that the Clerk and the Treasurer be authorized to draw a voucher on F, M,
2771 Right-of-clay Fund payable to Felix R, Real, Esther R, Real, Felix R. Real, Jr „ and
Lillian Stieler Real in the amount of $890,70 on delivery of the executed right-of-way ease-
ment and channel easements, provided that it is further agreed that partial releases be provi,l-
ed from the holders of all liens of record against the right-of-way and easements granted,
such partial releases to be drawn by Kerr County at no cost to owners.

matter of compensation to be offered James St. Aubyn Spicer for conveyance of right-of-way, aril
one channel easement required for F, M, Road 2771; and after due consideration, it is ordered
on motion by Commissioner Stone, seconded by Commissioner Schwethelm and una-~imously approved
by the Court that Kerr County hereby offers to pay James St. Aubyn Spicer the sum of X269.60
for land and damages upon his conveyance of 2.723 acres of right-of-way out of Surveys 405,
J. T. Peacock and 402, Julius Chevalier, together with one channel easement comprising
approximately 0,115 acres out of Survey 402, and it is further ordered that in addition to the
above cash consideration, Kerr County will construct a new fence along the new right-of-way
line, said fence to consist of heart cedar posts set 25 feet apart with 3 heart cedar stays
between each post and 832-12-12 1/2 net wire with 3 barb wires on top, and further Kerr County
will build a new entrance cattle guard and install one 12 foot steel gate at a location
acceptable to Mr, Spicer and the Texas Highway Department, and it is further ordered that
the Clerk and the Treasurer be authorized to draw a voucher on F, M, 2771 Right-of-Way Fund
