NEUNHOFFER, COUNTY JUDGE, Presiding; and W. C. SCHWETHELM COMMISSIONER, Precinct No. 1; PRENTICE WITT COMMISSIONER, Precinct No. 2; ADOLPH BARTEL COMMISSIONER, Precinct No. 3; ROGER STONE COMMISSIONER, Precinct No. 4; when, among other proceedings had by said Court, were the following: The County Judge submitted to the Court the following order: WHEREAS, on this the 12th day of November, 1963, there came on to be considered the returns of an election held in Kerr County, Texas, on the 9th day of November, 1963, to determine whether the bonds of said County shall be issued in the amount of X400,000 for permanent improvements, additions and repairs to the County Courthouse and Jail Building located in the City of Kerrville, the county seat of Kerr County, Texas, to mature serially at such time as may be deemed most expedient by the Commissioners' Court but not later than forty (40) years from the date thereof, and to bear interest at a rate not to exceed SIX PER CENTUM (6,~) per annum, and to levy ad valorem taxes sufficient to pay the interest on such bonds and create a sinking fund sufficient to pay the principal thereof at maturity; and WHEREAS, it appears from said returns that there were cast at said election 1516 votes on the proposition for the issuance of said bonds, of which number 551 votes were cast "FOR THE ISSUANCE OF BONDS AND THE LEVYING OF THE TAX IN PAYMENT THEREOF"; and 965 votes were cast "AGAINST THE ISSUANCE OF BONDS AND THE LEVYING OF THE TAX IN PAYMENT THEREOF"; and there- fore IT IS ORDERED AND DECLARED BY THE COMMISSIONERS' COURT OF KERB COUNTY, TEXAS: SECTION 1: That the aforesaid election was duly and legally called and notice thereof given in accordance with the laws of the State of Texas and the order calling said election; and that said election was held in strict conformity with the Constitution and laws of the State of Texas, and the returns thereof have been properly made to the officials of said County entitled to receive same; and that only resident qualified property taxpaying voters of said County, who own property therein subject to taxation and who have duly rendered the same for taxation were permitted to vote at said election; and, further, that said election properly represents the desires of those qualified to vote as aforesaid. ` SECTION 2: That the proposition to issue said X400,000 Courthouse and Jail Building Bonds and the levy of ad valorem taxes in payment thereof was defeated by a ma3ority of the legally qualified voters of said Kerr County, Texas, who are resident property taxpayers of said County and who have duly rendered said property for taxation, voting at said election, and that the 111 Commissioners Court of Kerr County is not authorized to issue said bonds and to levy and have assessed and collected said tax for the payment of principal and interest on such bonds. The above order having been read in full, it was moved by Commissioner Witt and seconded by Commissioner Bartel that the same be passed. Thereupon, the question being called for, the following members of the Court voted "AYE": Commissioners Schwethelm, Witt, Bartel and Stone, and the following voted "NO", NONE, The County Judge declared the motion carried and the order passed, and the Clerk was directed to record same in the proper Minutes of the Court.
