TO THE HONORABLE COMMISSIONERS' CL7URT OF SAID COUNTY:
Now comes the undersigned free holders in Pxecincet Number
Four, Kerr County, Texas, and being all the property owners affected,
and as petitioners, make this their joint application to alter, change and
close as a public alley, the alley shown in Block 2, Pierson Addition, a
Subdivision, located in Precinct Number Four, Kexx County, Texas,
described more particularly below, and fox such petition would respect-
fully show:
I.
There exists a passageway, roadway, ox alley, in Precinct Number
Four, Kexx County, Texas, averaging fifteen feet in width, shown as an
alley in Block 2, Pierson Addition to the town of Ingram, Kexx County,
Texas, which is described as follows, to-wit:
All that certain tract ox parcel of land lying and
being situated in the County of Kerr, State of Texas,
out of Survey No. 129, F. Trevino, and being a strip
of land 15 feet wide commencing at the corner of an
unnamed street between Pierson Addition to the town
of Ingram, Kexr County, Texas, and Mosel=s Section
"A", Second Addition to the town of Ingram, Kexr
County, Texas, and running N 58°14` W approximately
717 feet to the corner of Austin Street in Pierson
Addition, and being designated as an alley running
through Block 2, Pierson Addition to the town of Ingram,
Kerr County, Texas, in accordance with the map and
plat of said addition recorded in Volume 1, Page 67,
Plat Records, Kexr County, Texas, to which reference
is here made fox all purposes,
II.
The undersigned free holders of Precinct Foux of Kexx County, Texas,
being all the affected property owners, and petitioners herein, represent
that the existing alley is not being used and is not needed fox any purpose,
present and/ox future, and that the undersigned axe all of the property
owners in Block 2 of said Pierson Addition, and that fox the convenience
and welfare of themselves and the public generally, they desire that the
hexeiuabove described alley be closed as an alley, in accordance with
Article 6705 of the 1925 Revised Civil Statutes of the State of Texas, and
all applicable statutes.
III.
Petitionersfurthex represent unto the court that the undersigned
axe all of the property owners affected in that the alley, as hereinbefoxe
described, traverses the back part of the land owned by the undersigned;
that there is no need or use for said alley and it would be of rnatexial
benefit to the owners to close said alley and revert title to the affected
property owners for their further use and benefit.
IV.
Your petitioners further represent that prior to the filing of this
petition, and on the 13th day of April, A. D, 1963, formal written notice
of this intended application to alter, change and close as an alley the
above described passageway has been posted up at the Courthouse Doox
of Kexx County, Texas, and at two other public places in the vicinity of
the hereinabove described alley in Block 2, Pierson Addition to the town
of Ingram, Kerr County, Texas, namely, Ranchman=s Wool and Mohair
Company, U,S,Postoffice,ingxam,Texas„ to remain fox at least twenty
(20) days before hearing the decision on this application and petition, in
accordance with Article 6705 of the 1925 Revised Civil Statutes of the
State of Texas.
WHEREFORE, Petitioners pray that after said public written notices
have been posted as above set out fox twenty (20) days, that this Honorable
Court make a full investigation and consider this application and petition,
and that upon hearing and consideration that the hereinabove described
part of said alley be closed.
