ORDER NO. 9489 ORDER ACCEPTING DONATION OF RIGHT-OF-WAY for F, M, ROAD 2771 FROM OSCAR NEUNHOFFER, OSCAR NEUNHOFFER, JR, , and WIFE, ANNA E, NEUNHOFFER On this the 26th day of July, 1963, came on to be heard and consider- ed by the Court the offer of Oscar Neunhoffer, Oscar Neunhoffer, Sr. , and wife, Anna E. Neunhoffer, to donate right-o£-way easements as to their right, title and interest in certain tracts totaling 11.96 acres of land out of Surveys 399 John Bloom, 404 Joseph Purcell, 398 A. Cameron, 397 Chas. Veich, 395 Mrs. A. Clark, 394 Thomas Jackson, 393 J. Hinch, and 64 Wm, Watt, and their right, title and interests as to 4 channel easements comprising 0.1529 acres out of Surveys 399, 404, and 393; and it appearing to the Court after d2te consider- ation that it would be in the best interests of Kerr County to do so, it is csrd,ered and approved by the Court by a majority vote with Commissioners r~~:i'tel, Stone and Witt voting "AYE" and Commissioner Schwethelm vdting,'!NO" I that the offer of Oscar Neunhoffer, Oscar Neunhoffer, Jr„ and Anna 1C. Neun- hoffer as set forth be accepted and that Kerr County will construct a new fence along the new right-of-way line and the property lines of the grantors as they may exist along the right-of-way subsequent to construction of F. M. Road 2771, said fence to consist of heart cedar posts set 25 feet apart with 3 heart cedar stays between each post and 832-12-12 1(L net wire with 3 barb wires on top and further Kerr County will build a new entrance cattle guard, provide 3 new 12 foot steel gates and relocate 1 existing steel gate, exceptthat where a deer proof fence presently exists from Station 160-/03 to Station 17680, a deer proof fence will be built tokhe same general standards as used by Kerr County on State Highway 41, with one 10 foot steel gate to be furnished by Kerr County, and that from Station 176f80 to Station 228 -(88.8 Kerr County will build an additional 5, 128 feet of deer proof fence to the same standards furnishing four 12 foot gates; and further making special provisions in such fence for water flowing from the channels of existing terraces and reshape the newly created ends of such existing terraces as to permit farm machinery to cross the same in the same manner as is done at the existing terrace ends, and it is ordered that on completion of con- struction of F. M. Road 2771, such portions of abutting county roadways as shall no longer be required for public use shall be considered abandoned and shall re- vert to the holders of record title thereto.
