This is a reminder for you to forward to my Department a certified copy of the
order to be passed by your Cununiscioner:;' Court on Januar;,~ 14, 1963, plac in}* the
officers of your county either on a fee or salary basis for the calendar year
1963. I shall appreciate your sending this order as soon as possible after your
Commissioner's Court meets at its first regular !neeting. This i:. needed to deter-
mine the basis for the payment of ,coney to your county officers and until. it is re-
ceived this; department cannot either pay your county officers or your county any
money.
The above request is provided for in Article 3912e, Section ?_, R.C.S. rYhich reads.,
"Sec. 2. The Commissioners' Court of each county in the State ,f Texa:, at it:;
first regular meeting_in January ofeachca endar year. sha1.1, by order made and
entered in the minutes of said court, determine orhether preci.net. of flcerr of such
county (except public weighers and registrars of vita]. statistics steal] be com-
pensated on a salary basis as provided for in this act or whether they shall re-
ceive as their compensation, such fees of office as may be earned by them in the
performance of the duties of their offices, and i.t steal] be the duty of the cormty
clerk of each county to foxvrard to the_Cor~troller of Public Accounts o_f t}le State
of Teras on or before the 31st day of January a cer+ified _copy of such order. In
counties having a population of less than twenty thousand ~0,00~ inhabitant;;
according to the ]_ast preceding Federal Census, it shall likewise be the dut.;y of
the Commissioners Court, by its order duly made and entered of record at ft:; i.'irst.
regular meeting in January of each calendar year, to determine whether aunty offi-
cers of :;uch county (excluding county surveyors, registars. of vital statistics and
notaries (public) shall be compensated for. the fiscal year on the basis of an annual
salary or whether they shall be eompensated on the basic of fees earned by them 'in
