This is a reminder for you to forward to my Department a certified copy of the
order to be passed by your Conunissi.oners' Court on January 14, 1963, placinFr, the
officers of ,your county either on a fee or salary basis for the calendar year
1963. I shall appreciate your sending this order as soon as possible after your
Commissioner's Court meet: at its first regular meetinC. This is needed to deter-
mine the basis for the payment of money to your county officers and until it is re-
ceived thl:; department cannot either pay your county ~ff:icers or your county any
money.
The above request i^ provided for in Article 3~ ?e, Section 2, F.C.S. which reads,
"Sec. 2. The Commissioners' Court of each county in the State ,~f Texa:~, at its
first regular meeting; in January of each ctil.endar ,year, eha]1, by order made and
entered in the minutes of said court, determine ~,rhether precinct officers of such
county (except public weighers and re[;istrare oi' vital statistics :.hall. be com-
pensated on a salary basis as provided for in this act o.r whether they shall re-
ceive a: their compensation, such fee^ of office as may be earned by them in the
performance of the duties of their offices, and ].t nhal]. be the duty of the county
clerk of each county to forward to the Comptroller of Public Accounts of the ~=,tate
of Texas on or before the 31st day cif January a certified _copy of such order. In
counties having a population of less than twenty thousand0,000 inhabi:j.a_^.te,
according to the last preceding Federal Census, ].t sYlall likewise be the duty of

Until we have received such order, this department is placed i_n this po:;ition, we
can neither pay ,your county any rnonie:; under the provisions of Article 3912e, R.C.S.
See. 6, (a) in the event your county officers have been placed on a salary basis,
nor any fees in the event your county has placed its officers nn a fee basis i'or
the calendar year 1963.
