THE STATE OF TEXAS ] COUNTY OF KERR X WHEREAS, on the 1st day of August, 1951, Clyde D. Parmelee and Barbara H. Parmelee did enter into an agreement with Sohn R. Leavell and Henry Eckstein, County Judge and Commissioner of Precinct One respective- ly of Kerr County, Texas, whereby the said Clyde D. Parmelee and Barbara H. Parmelee agree to convey certain lands for right-of-way for State High- way 27 in Kerr County, wherefor they were to receive as compensation certain consideration as is set forth in said agreement as is now recorded as a portion of Order No. 9818 of the Commissioners Court of Kerr County, Texas, in Vol. M, Page 194 of the Minutes of the said Court; and, WHEREAS, certain acts which were to be performed by Kerr County, Texas, as a portion of the consideration set forth in said agreement have not been performed and cannot now feasibly be performed; and, WHEREAS, by virtue of the aforesaid Order 9818 of the Commission- ers Court of Kerr County, an offer of settlement of all unsatisfied claims against Kerr County is set forth and has been found to be acceptable by the undersigned Barbara H. Parmelee in her individual capacity and as successor in title to Clyde D. Parmelee as to the lands concerned, THEREFORE, Know All Men by These Presents, that I, Barbara H. Parmelee, a feme sole, acting in the capacities herein set forth, for and in consideration of the sum of $150. 00 cash to me in hand paid, by Kerr County, Texas, receipt of which is hereby acknowledged and for the further considera- tion of the action of the Commissioners Court of Kerr County, Texas in declar- ing closed and abandoned forever an unopened roadway in the Bivouac Estates Addition of Kerr County, Texas, which action is evidenced by Order No. 9817 of the said Court as recorded in Vol. M, Page 194 of the Court minutes, do hereby release forever the aforesaid Kerr County, Texas, its legal representa- tives and successors from any further liability whatsoever arising from the terms of the aforesaid agreement dated August 1, 1951, and this agreement of rlease shall be binding on myself, my heirs and assigns forever. ll Witness my hand at Kerrville, Texas, this the ', `1 ~ ` day of :L^ -~,-~~ , ,z ~{ > 1964. --~ Barbara H.
