i~~ the offer of Camp Mystic, Inc,, to donate 1,201 acres of land out of S~.zrveys 1357 and 1497 and the offer of Agnes D, Stacy Neff, Anne Stacy Eastland and W, G. Stacy to donate 0.120 acres of land out of Survey 1226, both the said donations of land being to the State of Texas for right-of-way for State Highway No, 39 near the Camp Mystic crossing and it appearing to the Court that the offers to donate the aforesaid right-of-way on the terms offered by the donors should be accepted by Kerr County, it is ordered on motion by Commissioner Witt seconded by Commissioner Schwethelm and unanimously approved by the Court that the offer of Camp Mystic, Inc,, and of Agnes D, Stacy Neff, Anne Stacy Eastland and .d. G, Stacy to donate the two tracts of right-of-way as aforesaid be accepted by Kerr County acting for and in behalf of the State of Texas, and that for and in consideration of the said donations and for and in consideration of the exec,.ztion of a G;uitclaim Deed by Camp Mystic, Inc,, covering 4,505 acres of abutting right-of-way to be secured by Kerr County from Mrs, Willis Ann griffin, Kerr County will erect new fences along the donors new property lines as abut the right-of-way tracts donated, such fences to be of a quality and standard at least equaling the donors present fences in the individual areas concerned; and it is further agreed that upon the quitclaiming to Kerr County by the State of Texas of those portions of the existing undeeded right-of-way of State Highway No. 3y in the proximity of the present Camp Mystic crossing of the South Fork of the Guadalupe River as are scheduled to be abandoned as a public roadway upon completion of the new roadway and bridge to be constructed on the right-of-way donated herein, Kerr County will execute ~:uitclaim Deeds to the then record owner or owners of title to such abandoned portions of right-of-way, o-n-o-o-o-o-o-o-o-o COURT ADJOURNED February 2~, 1964 at 11:30 o'clock A. '~dILLIE ANPd GkIFFIN FOk kIGHT-OF-WAY FOk STATE HIGHWAY 39 On this the 2nd day of March 1964, came on to be heard and considered by the Court the matter of an offer to Mrs. Willie Ann Griffin for payment for right-of-way required for State Highway 39 near Camp Mystic, and it appearing to the Court that the letter offer extended to Mrs. Griffin by Kerr County has been found to be acceptable by Mrs. Griffin, it is ordered on motion by Commissioner Stone, seconded by Corr~nissioner Bartel and unanimously approved by the Court that Kerr County will pay hirs. Willie Ann Griffin the sum of y2,000,00 for land and damages upon her conveyance to the State of Texas of 4.505 acres of land out of Surveys 1497 and 1357, and that in addition to the cash consideration offered, Kerr County will relocate all existing fences on the new right-of-way line, such relocated fences to be of a standard at least equal to the existing fences and with Kerr County replacing all materials necessary to accomplish the said relocation; and it is further agreed that Kerr County will re-imburse C. 0. Merritt an agreed sum for damages to his leasehold interest and growing crops located on the rifhtrof-way conve}~ed, and it is further ordered that the Clerk and the Treasurer be authorized ~-. to draw a voucher on the N.ighway 39 Fund in the amount of $2,000,00 payable to 'vlillie Ann Griffin upon receipt of the properly executed kight-of-way Deed, and upon its approval by the Texas Highway Department. o-c-c-c-o-o-o-o-o
